PAG LIN 1 1 Amend the amendment, S-3477, to House File 698, as 1 2 amended, passed, and reprinted by the House, as 1 3 follows: 1 4 #1. Page 2, by inserting after line 42 the 1 5 following: 1 6 "c. Any written record made by the department or 1 7 an employee of the department in an investigation or 1 8 assessment of a report of a child abuse." 1 9 #2. Page 10, by inserting after line 40 the 1 10 following: 1 11 "Sec. ___. Section 235A.20, Code 1997, is amended 1 12 to read as follows: 1 13 235A.20 CIVIL REMEDY. 1 14 Any aggrieved person may institute a civil action 1 15 for damages under chapter 669 or 670 or to restrain 1 16 the dissemination of child abuse information in 1 17 violation of this chapter, and any person, agency or 1 18 other recipient proven to have disseminated or to have 1 19 requested and received child abuse information in 1 20 violation of this chapter, or any employee of the 1 21 department who destroys investigation or assessment 1 22 data except in accordance with rule as established by 1 23 the department for retention of child abuse 1 24 information under section 235A.18 shall be liable for 1 25 actual damages and exemplary damages for each 1 26 violation and shall be liable for court costs, 1 27 expenses, and reasonable attorney's fees incurred by 1 28 the party bringing the action. In no case shall the 1 29 award for damages be less than one hundred dollars. 1 30 Sec. ___. Section 235A.21, subsection 1, Code 1 31 1997, is amended to read as follows: 1 32 1. Any person who willfully requests, obtains, or 1 33 seeks to obtain child abuse information under false 1 34 pretenses, or who willfully communicates or seeks to 1 35 communicate child abuse information to any agency or 1 36 person except in accordance with sections 235A.15 and 1 37 235A.17, or any person connected with any research 1 38 authorized pursuant to section 235A.15 who willfully 1 39 falsifies child abuse information or any records 1 40 relatingtheretoto child abuse information, or any 1 41 employee of the department who destroys investigation 1 42 or assessment data except in accordance with rule as 1 43 established by the department for retention of child 1 44 abuse information under section 235A.18 is guilty of a 1 45 serious misdemeanor. Any person who knowingly, but 1 46 without criminal purposes, communicates or seeks to 1 47 communicate child abuse information except in 1 48 accordance with sections 235A.15 and 235A.17 shall be 1 49 guilty of a simple misdemeanor."" 1 50 #3.
