PAG LIN 1 1 Amend Senate File 538 as follows: 1 2 #1. Page 1, by striking lines 1 through 26 and 1 3 inserting the following: 1 4 "Section 1. Section 422.12, subsection 2, Code 1 5 1997, is amended by striking the subsection. 1 6 Sec. 2. NEW SECTION. 422.12A TUITION TAX CREDIT. 1 7 1. The taxes imposed under this division, less the 1 8 credits allowed under sections 422.11A, 422.11B, 1 9 422.12, 422.12B, and other nonrefundable credits shall 1 10 be reduced by a tuition tax credit equal to twenty 1 11 percent of the first one thousand dollars which the 1 12 taxpayer has paid to others for each dependent in 1 13 grades kindergarten through twelve, for tuition and 1 14 textbooks of each dependent in attending an elementary 1 15 or secondary school situated in Iowa, which school is 1 16 accredited or approved under section 256.11, which is 1 17 not operated for profit, and which adheres to the 1 18 provisions of the federal Civil Rights Act of 1964 and 1 19 chapter 216. As used in this section, "textbooks" 1 20 means books and other instructional materials and 1 21 equipment used in elementary and secondary schools in 1 22 teaching only those subjects legally and commonly 1 23 taught in public elementary and secondary schools in 1 24 this state and does not include instructional books 1 25 and materials used in the teaching of religious 1 26 tenets, doctrines, or worship, the purpose of which is 1 27 to inculcate those tenets, doctrines, or worship, and 1 28 does include books or materials for extracurricular 1 29 activities including sporting events, musical or 1 30 dramatic events, speech activities, driver's 1 31 education, or programs of a similar nature. The 1 32 department, when conducting an audit of a taxpayer's 1 33 return, shall also audit the tuition tax credit 1 34 portion of the tax return. 1 35 2. As used in this section, "tuition" means any 1 36 charges for the expenses of personnel, buildings, 1 37 equipment and materials other than textbooks, and 1 38 other expenses of elementary or secondary schools 1 39 which relate to the teaching only of those subjects 1 40 legally and commonly taught in public elementary and 1 41 secondary schools in this state and which do not 1 42 relate to the teaching of religious tenets, doctrines, 1 43 or worship, the purpose of which is to inculcate those 1 44 tenets, doctrines, or worship, or which do relate to 1 45 extracurricular activities including sporting events, 1 46 musical or dramatic events, speech activities, 1 47 driver's education, or programs of a similar nature. 1 48 3. Any credit in excess of the tax liability shall 1 49 be refunded. In lieu of claiming a refund, a taxpayer 1 50 may elect to have the overpayment shown on the 2 1 taxpayer's final, completed return credited to the tax 2 2 liability for the following taxable year." 2 3 #2.
