1 1 Amend the amendment, S-3363, to House File 707, as
1 2 amended, passed, and reprinted by the House, as
1 3 follows:

1 8 "Sec. _ _. Section 321J.3, Code 1997, is amended
1 9 by adding the following new subsection:
1 10 NEW SUBSECTION. 3. The state department of
1 11 transportation, in cooperation with the judicial
1 12 department, shall adopt rules, pursuant to the
1 13 procedure in section 125.33, regarding the assignment
1 14 of persons ordered under section 321J.17 to submit to
1 15 substance abuse evaluation and treatment. The rules
1 16 shall be applicable only to persons other than those
1 17 committed to the custody of the director of the
1 18 department of corrections under section 321J.2. The
1 19 rules shall be consistent with the practices and
1 20 procedures of the judicial department in sentencing
1 21 persons to substance abuse evaluation and treatment
1 22 under section 321J.2. The rules shall include the
1 23 requirement that the treatment programs utilized by a
1 24 person pursuant to an order of the department meet the
1 25 licensure standards of the division of substance abuse
1 26 for the department of public health. The rules shall
1 27 also include provisions for payment of costs by the
1 28 offenders, including insurance reimbursement on behalf
1 29 of offenders, or other forms of funding, and shall
1 30 also address reporting requirements of the facility,
1 31 consistent with the provisions of sections 125.84 and
1 32 125.86. The department shall be entitled to treatment
1 33 information contained in reports to the department,
1 34 notwithstanding any provision of chapter 125 that
1 35 would restrict department access to treatment
1 36 information and records.""
