  1  1    Amend Senate File 493 as follows:
  1  2    #1.  Page 1, by striking lines 9 through 16 and
  1  3 inserting the following:
  1  4    "22.  INCOMPETENT – includes means the condition
  1  5 of any person who has been adjudicated by a court to
  1  6 be incapable of managing the person's property, or
  1  7 caring for the person's own self, or both to meet at
  1  8 least one of the following conditions:
  1  9    a.  To have a decision-making capacity which is so
  1 10 impaired that the person is unable to care for the
  1 11 person's personal safety or to attend to or provide
  1 12 for necessities for the person such as food, shelter,
  1 13 clothing, or medical care, without which physical
  1 14 injury or illness may occur.
  1 15    b.  To have a decision-making capacity which is so
  1 16 impaired that the person is unable to make,
  1 17 communicate, or carry out important decisions
  1 18 concerning the person's financial affairs.
  1 19    c.  To have a decision-making capacity which is so
  1 20 impaired that both paragraphs "a" and "b" are
  1 21 applicable to the person."
