1 2 #1. Page 3, by inserting before line 12 the
1 3 following:
1 4 "Sec. ___. NEW SECTION. 123.47D CEREAL BEVERAGE
1 5 WITH ALCOHOL – PERSONS UNDER LEGAL AGE – PENALTIES.
1 6 A person who is under legal age shall not possess
1 7 any cereal beverage with any alcohol content under the
1 8 name of "near beer", "brew", "bru", or any other name
1 9 which conveys or implies to the person that the
1 10 beverage has an alcohol content. A person who
1 11 violates this section commits a simple misdemeanor
1 12 punishable by a fine of one hundred dollars. A person
1 13 who is under the age of eighteen who commits a
1 14 violation of this section shall not be detained or
1 15 placed in a secure facility instead of paying, or for
1 16 failure to pay, the fine imposed under this section.
1 17 The chief judge of each judicial district shall
1 18 designate a person who is responsible for ensuring
1 19 that any fines imposed are collected."
1 20 #2. Page 21, by inserting after line 18 the
1 21 following:
1 22 "Sec. . Section 805.16, subsection 1, Code
1 23 1997, is amended to read as follows:
1 24 1. Except as provided in subsection 2 of this
1 25 section, a peace officer shall issue a police citation
1 26 or uniform citation and complaint, in lieu of making a
1 27 warrantless arrest, to a person under eighteen years
1 28 of age accused of committing a simple misdemeanor
1 29 under chapter 321, 321G, 461A, 461B, 462A, 481A, 481B,
1 30 483A, 484A, 484B, section 123.47 or 123.47D, or a
1 31 local ordinance not subject to the jurisdiction of the
1 32 juvenile court, and shall not detain or confine the
1 33 person in a facility regulated under chapter 356 or
1 34 356A."
