  1  1    Amend Senate File 518 as follows:
  1  2    #1.  Page 2, line 21, by inserting after the word
  1  3 "department." the following:  "In determining the
  1  4 competence of a bidder, the department may consider
  1  5 such factors as the quality of the item or service,
  1  6 the bidder's management abilities, the bidder's
  1  7 proposed plan for providing the items or services
  1  8 requested, the financial stability of the bidder, the
  1  9 bidder's ability to timely perform, the bidder's
  1 10 ability to provide ongoing services such as
  1 11 maintenance, training, and support, the bidder's past
  1 12 and current performance on other similar contracts,
  1 13 and the bidder's specialized or technical expertise."
  1 14    #2.  Page 2, line 22, by inserting after the word
  1 15 "items" the following:  "or services".
  1 16    #3.  Page 2, line 23, by inserting after the word
  1 17 "bid." the following:  "The lowest competent bid or
  1 18 bids may be determined after best and final offer
  1 19 negotiations with qualified bidders as disclosed in
  1 20 the bid specifications.  Notwithstanding section 72.3,
  1 21 in any procurement made under this chapter, the
  1 22 director, following submittal and evaluation of bids,
  1 23 may enter into best and final offer negotiations with
  1 24 qualified bidders in order to obtain the lowest price
  1 25 possible on an item or service.  The director shall
  1 26 adopt rules pursuant to chapter 17A providing for the
  1 27 circumstances under which best and final offer
  1 28 negotiations may be conducted and procedures for
  1 29 conducting negotiations with qualified bidders."
