1 4 "subsection" and inserting the following:
1 5 "subsections".
1 6 #2. Page 2, by inserting after line 2 the
1 7 following:
1 8 "NEW SUBSECTION. 7. Review team members and their
1 9 agents are immune from any liability, civil or
1 10 criminal, which might otherwise be incurred or imposed
1 11 as a result of any act, omission, proceeding,
1 12 decision, or determination undertaken or performed, or
1 13 recommendation made as a review team member or agent
1 14 provided that the review team members or agents acted
1 15 in good faith and without malice in carrying out their
1 16 official duties in their official capacity. The
1 17 department shall adopt rules pursuant to chapter 17A
1 18 to administer this subsection. A complainant bears
1 19 the burden of proof in establishing malice or lack of
1 20 good faith in an action brought against review team
1 21 members involving the performance of their duties and
1 22 powers under this section."
