  1  1       DIVISION I – CLEAN FUND REPEAL – LOTTERY TRANSFER
  1  2    Section 1.  Section 8.22A, subsection 5, paragraph a, Code
  1  3 1997, is amended to read as follows:
  1  4    a.  The amount of lottery revenues for the following fiscal
  1  5 year to be available for disbursement transferred from the
  1  6 lottery fund to the general fund of the state following the
  1  7 deductions made pursuant to section 99E.10, subsection 1.
  1  8    Sec. 2.  Section 99E.10, subsection 1, unnumbered paragraph
  1  9 3, Code Supplement 1997, is amended to read as follows:
  1 10    The committing the lottery to environment, agriculture, and
  1 11 natural resources fund, also to be known as the CLEAN fund, is
  1 12 created in the office of the treasurer of state.  Lottery
  1 13 revenue remaining after expenses are determined shall be
  1 14 transferred to the CLEAN general fund of the state on a
  1 15 monthly basis.  Revenues generated during the last month of
  1 16 the fiscal year which are transferred to the CLEAN general
  1 17 fund of the state during the following fiscal year shall be
  1 18 considered revenues transferred during the previous fiscal
  1 19 year for purposes of the allotments made to and appropriations
  1 20 made from the separate accounts in the CLEAN fund for that
  1 21 previous fiscal year.  However, upon the request of the
  1 22 director and subject to approval by the treasurer of state, an
  1 23 amount sufficient to cover the foreseeable administrative
  1 24 expenses of the lottery for a period of twenty-one days may be
  1 25 retained from the lottery revenue.  Prior to the monthly
  1 26 transfer to the CLEAN general fund of the state, the director
  1 27 may direct that lottery revenue shall be deposited in the
  1 28 lottery fund and in interest-bearing accounts designated by
  1 29 the treasurer of state in the financial institutions of this
  1 30 state or invested in the manner provided in section 12B.10.
  1 31 Interest or earnings paid on the deposits or investments is
  1 32 considered lottery revenue and shall be transferred to the
  1 33 CLEAN general fund of the state in the same manner as other
  1 34 lottery revenue.  Money in the CLEAN fund shall be deposited
  1 35 in interest-bearing accounts in financial institutions in this
  2  1 state or invested in the manner provided in section 12B.10.
  2  2 The interest or earnings on the deposits or investments shall
  2  3 be considered part of the CLEAN fund and shall be retained in
  2  4 the fund unless appropriated by the general assembly.
  2  5    Sec. 3.  Section 99E.10, subsection 2, Code Supplement
  2  6 1997, is amended to read as follows:
  2  7    2.  The director of management shall not include lottery
  2  8 revenues in the director's fiscal year revenue estimates.
  2  9 Moneys in the CLEAN fund shall not be considered a part of the
  2 10 Iowa economic emergency fund.
  2 11    Sec. 4.  Section 99E.20, subsection 2, Code 1997, is
  2 12 amended to read as follows:
  2 13    2.  A lottery fund is created in the office of the
  2 14 treasurer of state.  The fund consists of all revenues
  2 15 received from the sale of lottery tickets or shares and all
  2 16 other moneys lawfully credited or transferred to the fund.
  2 17 The commissioner shall certify monthly that portion of the
  2 18 fund that is transferred to the CLEAN general fund of the
  2 19 state under section 99E.10 and shall cause that portion to be
  2 20 transferred to the CLEAN general fund of the state.  The
  2 21 commissioner shall certify before the twentieth of each month
  2 22 that portion of the lottery fund resulting from the previous
  2 23 month's sales to be transferred to the CLEAN general fund of
  2 24 the state.
  2 25    Sec. 5.  Section 99E.34, Code 1997, is repealed.  
  2 26      DIVISION II – DATE FOR SPECIAL EDUCATION ENROLLMENT
  2 27    Sec. 6.  Section 257.6, subsection 3, unnumbered paragraph
  2 28 1, Code 1997, is amended to read as follows:
  2 29    A school district shall determine its additional enrollment
  2 30 because of special education, as defined in this section, on
  2 31 December 1 the last Friday in October of each year and shall
  2 32 certify its additional enrollment because of special education
  2 33 to the department of education by December November 15 of each
  2 34 year, and the department shall promptly forward the
  2 35 information to the department of management.
  3  1    Sec. 7.  Section 257.6, subsection 5, unnumbered paragraph
  3  2 1, Code 1997, is amended to read as follows:
  3  3    Weighted enrollment is the budget enrollment plus the
  3  4 district's additional enrollment because of special education
  3  5 calculated on December 1 the last Friday in October of the
  3  6 base year plus additional pupils added due to the application
  3  7 of the supplementary weighting.
  3  8    Sec. 8.  Section 273.5, subsection 5, Code 1997, is amended
  3  9 to read as follows:
  3 10    5.  Provide each school district within the area served and
  3 11 the department of education with a special education weighted
  3 12 enrollment count, including the additional enrollment because
  3 13 of special education for December 1 the last Friday in October
  3 14 of each year.  
  3 15                           EXPLANATION 
  3 16    Division I of this bill repeals provisions relating to the
  3 17 committing the lottery to environment, agriculture, and
  3 18 natural resources (CLEAN) fund and deposit of lottery proceeds
  3 19 into that fund.  The bill instead provides for deposit of the
  3 20 lottery proceeds into the general fund of the state.
  3 21    Division II of this bill changes the date for determining
  3 22 additional enrollment for special education under the school
  3 23 aid program from December 1 to the last Friday in October and
  3 24 changes the certification date of that amount from December 15
  3 25 to November 15.
