  1  1    Section 1.  Section 272.1, Code 1997, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  4A.  "Para-educator" means a person who is
  1  4 licensed to assist a teacher in the performance of
  1  5 instructional tasks to support and assist classroom
  1  6 instruction and related school activities.
  1  7    Sec. 2.  NEW SECTION.  272.12  PARA-EDUCATOR LICENSES.
  1  8    1.  The board of educational examiners shall adopt rules
  1  9 pursuant to chapter 17A relating to a two-level voluntary
  1 10 license for para-educators and outlining the instructional and
  1 11 other school activity tasks the individuals licensed under
  1 12 this section may perform.  The board shall determine whether
  1 13 an applicant is qualified to perform the duties for which a
  1 14 para-educator license is sought.
  1 15    2.  Applicants for a para-educator license as a generalist
  1 16 must hold a high school diploma from an accredited secondary
  1 17 school or a high school equivalency diploma issued in
  1 18 accordance with chapter 259A.  The applicant must also have
  1 19 completed twenty clock hours of in-service training in a
  1 20 combination of all of the following areas:
  1 21    a.  Behavior management.
  1 22    b.  Ethical responsibilities and behavior.
  1 23    c.  Exceptional child and at-risk child behavior.
  1 24    d.  Collaboration skills and interpersonal relations.
  1 25    e.  Child and youth development.
  1 26    3.  Applicants for a para-educator license as a specialist
  1 27 in early childhood, technology, or activity and recreation
  1 28 supervision must meet the requirements of subsection 2.  The
  1 29 applicant must also have completed an additional thirty clock
  1 30 hours of in-service training in the area of specialist
  1 31 licensure, for which thirty clock hours of supervised
  1 32 experience gained as a licensed generalist may be substituted.
  1 33    4.  Applicants shall be disqualified for any of the
  1 34 following reasons:
  1 35    a.  The applicant is less than eighteen years of age.
  2  1    b.  The applicant has a record of founded child abuse.
  2  2    c.  The applicant has been convicted of a felony.
  2  3    d.  The applicant's application is fraudulent.
  2  4    e.  The applicant's license or certification from another
  2  5 state is suspended or revoked.
  2  6    f.  The applicant fails to meet board standards for
  2  7 application for an initial or renewed license.
  2  8    5.  Qualifications or criteria for the granting or
  2  9 revocation of a license or the determination of an
  2 10 individual's professional standing shall not include
  2 11 membership or nonmembership in any teachers' organization.  
  2 12                           EXPLANATION
  2 13    This bill requires the state board of educational examiners
  2 14 to adopt rules relating to a two-level voluntary license for
  2 15 para-educators, which the bill defines as a person who is
  2 16 licensed to assist a teacher in the performance of
  2 17 instructional tasks to support and assist classroom
  2 18 instruction and related school activities.
  2 19    Applicants for a para-educator license as a generalist must
  2 20 hold a high school diploma from an accredited secondary school
  2 21 or a high school equivalency diploma.  The applicant must also
  2 22 have completed 20 hours of in-service training in a
  2 23 combination of areas described in the bill.
  2 24    Applicants for a para-educator license as a specialist in
  2 25 early childhood, technology, or activity and recreation
  2 26 supervision must meet the requirements for a license as a
  2 27 generalist, and must also have completed an additional 30
  2 28 hours of in-service training the area of specialist licensure,
  2 29 for which 30 clock hours of supervised experience gained as a
  2 30 licensed generalist may be substituted.
  2 31    The bill lists a number of reasons why an applicant shall
  2 32 be disqualified from being issued or holding a license.
