PAG LIN 1 1 Section 1. Section 198.3, subsection 3, Code 1997, is 1 2 amended to read as follows: 1 3 3. "Commercial feed" means all materialsexceptor a 1 4 combination of materials which are distributed or intended for 1 5 distribution for use as feed or for mixing in feed, unless 1 6 such materials are specifically exempted. Unmixed whole seeds 1 7unmixed orand physically altered entire unmixed seeds, when 1 8 such whole or physically altered seeds are not chemically 1 9 changed or are not adulterated within the meaning of section 1 10 198.7, subsection 1,whicharedistributed for use as feed or1 11for mixing in feedexempt. The secretary by rule may exempt 1 12 from this definition, or from specific provisions of this 1 13 chapter, commodities such as hay, straw, stover, silage, cobs, 1 14 husks, hulls and individual chemical compounds or substances 1 15 when such commodities, compounds or substances are not 1 16 intermixed or mixed with other materials, and are not 1 17 adulterated within the meaning of section 198.7, subsection 1. 1 18 Sec. 2. Section 198.4, subsection 1, unnumbered paragraph 1 19 1, Code 1997, is amended by striking the paragraph and 1 20 inserting in lieu thereof the following: 1 21 This section shall apply to any person: 1 22 a. Who manufactures a commercial feed within the state. 1 23 b. Who distributes a commercial feed in or into the state. 1 24 c. Whose name appears on the label of a commercial feed as 1 25 guarantor. 1 26 The person shall obtain a license, for each facility which 1 27 distributes in or into the state, authorizing the person to 1 28 manufacture or distribute commercial feed before the person 1 29 engages in such activity. Any person who makes only retail 1 30 sales of commercial feed which bears labeling or other 1 31 approved indication that the commercial feed is from a 1 32 licensed manufacturer, guarantor, or distributor who has 1 33 assumed full responsibility for the tonnage inspection fee due 1 34 under section 198.9 is not required to obtain a license. 1 35 EXPLANATION 2 1 This bill amends Code chapter 198, the "Iowa Commercial 2 2 Feed Law". The bill amends Code section 198.3 which provides 2 3 that commercial feed does not include certain seeds. This 2 4 bill provides that the exemption does not apply to seeds which 2 5 have been chemically changed. The bill also amends Code 2 6 section 198.4, which requires that persons must be licensed if 2 7 they manufacture a commercial feed, if the person's name 2 8 appears on the label of a commercial feed, or if the person is 2 9 a broker of commercial feed. This bill provides that the 2 10 manufacturer, distributor, and broker must still receive a 2 11 license. It provides that a person whose name appears on the 2 12 commercial feed label as a guarantor must also be licensed. 2 13 The bill provides that a person is not required to obtain a 2 14 license if the person makes only retail sales of commercial 2 15 feed and the commercial feed bears a label providing that the 2 16 commercial feed comes from a licensed manufacturer, guarantor, 2 17 or distributor who is responsible for paying an inspection fee 2 18 imposed under the chapter. 2 19 LSB 3934HC 77 2 20 da/cf/24.1
