PAG LIN 1 1 Section 1. Section 8.57, subsection 5, paragraph c, Code 1 2 1997, is amended to read as follows: 1 3 c. Moneys in the fundin a fiscal yearshall be used as 1 4directedfollows: 1 5 (1) Beginning July 1, 1999, as recommended by the rebuild 1 6 Iowa infrastructure commission, appropriated by the general 1 7 assembly, and approved by the governor for public vertical 1 8 infrastructure projects. 1 9 (2) Beginning July 1, 2001, for each fiscal year, thirty 1 10 percent of the moneys deposited in the fund is appropriated to 1 11 the state board of regents for vertical infrastructure 1 12 projects at regents institutions. 1 13 For the purposes of this subsection, "vertical 1 14 infrastructure" includes only land acquisition and 1 15 construction, major renovation and major repair of buildings, 1 16 all appurtenant structures, utilities, site development, and 1 17 recreational trails. "Vertical infrastructure" does not 1 18 include routine, recurring maintenance or operational expenses 1 19 or leasing of a building, appurtenant structure, or utility 1 20 without a lease-purchase agreement. However, appropriations 1 21 may be made for the fiscal years beginning July 1, 1997,and1 22 July 1, 1998, and July 1, 1999, for the purpose of funding the 1 23 completion of Part III of the Iowa communications network. 1 24 Sec. 2. NEW SECTION. 18.141 REBUILD IOWA INFRASTRUCTURE 1 25 COMMISSION LEGISLATIVE INTENT. 1 26 It is the intent of the general assembly that a rebuild 1 27 Iowa infrastructure commission operate to enhance cooperation 1 28 among all state agencies and branches of government in the 1 29 management and protection of the state's vertical 1 30 infrastructure. It is also the intent of the general assembly 1 31 that the commission operate to further the efficient 1 32 management and protection of the state's investment in its 1 33 vertical infrastructure through the implementation of a 1 34 comprehensive plan to maintain, renovate, or rebuild state 1 35 facilities to continue to meet the needs, health, and safety 2 1 of the citizens of the state and visitors to the facilities. 2 2 The general assembly intends that the commission make 2 3 recommendations regarding vertical infrastructure projects 2 4 while maintaining an appreciation for the many historic 2 5 facilities in the state and that the commission continue 2 6 efforts to preserve those facilities where feasible and 2 7 justifiable. 2 8 Sec. 3. NEW SECTION. 18.142 DEFINITIONS. 2 9 As used in this division, "state agency" does not include 2 10 the state board of regents or institutions under the control 2 11 of the state board of regents. 2 12 Sec. 4. NEW SECTION. 18.143 REBUILD IOWA INFRASTRUCTURE 2 13 COMMISSION. 2 14 1. A rebuild Iowa infrastructure commission is created 2 15 consisting of seven members appointed by the governor to four- 2 16 year staggered terms and confirmed by the senate in accordance 2 17 with chapter 69. A vacancy on the commission shall be filled 2 18 in the same manner as regular appointments are made for the 2 19 unexpired portion of the regular term. 2 20 2. Members shall be persons having expertise or knowledge 2 21 in the areas of architecture, construction, historic 2 22 preservation, energy conservation, or finance or accounting, 2 23 or persons with an interest in vertical infrastructure in 2 24 Iowa. Not more than two members shall have a direct or 2 25 indirect interest, at the time of appointment, in a 2 26 construction, architectural, engineering, consulting, or other 2 27 entity which seeks or has been awarded a contract or 2 28 subcontract for any aspect of a vertical infrastructure 2 29 project recommended by the commission for funding through the 2 30 rebuild Iowa infrastructure fund. A member with a direct or 2 31 indirect conflict of interest shall not participate in any 2 32 action relating to the project involving the conflict of 2 33 interest. Members of the commission shall comply with chapter 2 34 68B and shall give a surety bond in an amount determined by 2 35 the governor. The premium on the bond shall be paid from the 3 1 general fund of the state. 3 2 3. The commission shall select annually a chairperson and 3 3 vice chairperson from among its members. The commission shall 3 4 meet at the call of the chairperson or when any four members 3 5 of the commission file a written request with the chairperson 3 6 for a meeting. Written notice of the time and place of each 3 7 meeting shall be given to each member of the commission. A 3 8 majority of the members constitutes a quorum. Members of the 3 9 commission shall be allowed their actual and necessary 3 10 expenses incurred in the performance of their official duties 3 11 and a per diem in accordance with section 7E.6. All expenses, 3 12 including per diem expenses, of the commission shall be paid 3 13 from appropriations to the department for that purpose and the 3 14 department shall be subject to the budget requirements of 3 15 chapter 8 for purposes relating to the commission. 3 16 4. A member of the commission may be removed for any of 3 17 the causes and in the manner provided in chapter 66. Removal 3 18 shall not be in lieu of any other punishment that may be 3 19 prescribed by the laws of this state. 3 20 Sec. 5. NEW SECTION. 18.144 DUTIES OF THE COMMISSION. 3 21 The commission shall do all of the following: 3 22 1. Adopt administrative rules necessary to the mission and 3 23 duties of the commission. 3 24 2. Develop a comprehensive plan for deferred maintenance, 3 25 renovation, and reconstruction of the state's vertical 3 26 infrastructure, and update the plan on an annual basis. 3 27 3. Develop and implement a method for evaluating vertical 3 28 infrastructure needs and proposals submitted by state 3 29 agencies, and develop and implement guidelines, procedures, 3 30 policies, and priorities for review of the needs and proposals 3 31 and for the development of the comprehensive plan. 3 32 4. Submit each year, in accordance with section 2.16, a 3 33 bill containing vertical infrastructure project 3 34 recommendations based upon the comprehensive plan developed 3 35 under this section. Recommendations shall include the level 4 1 of funding necessary to complete each project recommended, and 4 2 a timetable for completion of the project if the project is 4 3 anticipated to require more than one year to complete. 4 4 5. Maintain an inventory of state facilities and estimated 4 5 values of the facilities, and update the inventory as 4 6 necessary. 4 7 6. Establish uniform criteria based on the comprehensive 4 8 plan developed under this section which state agencies shall 4 9 utilize in submitting project proposals to the commission, and 4 10 evaluate those proposals based on the criteria contained in 4 11 the comprehensive plan. 4 12 7. Require state agencies to submit an inventory of their 4 13 state facilities, submit project proposals, and if they 4 14 receive funding from the rebuild Iowa infrastructure fund for 4 15 vertical infrastructure projects, to periodically account to 4 16 the commission for expenditures on, and the progress of, the 4 17 projects. 4 18 8. As necessary, enter into agreements with public or 4 19 private entities to carry out the mission and duties of the 4 20 commission. 4 21 9. Recommend to the general assembly statutory changes 4 22 necessary to ensure an effective, well-managed vertical 4 23 infrastructure program. 4 24 Sec. 6. NEW SECTION. 18.145 VERTICAL INFRASTRUCTURE 4 25 PROJECT PROPOSALS APPROVAL BY GENERAL ASSEMBLY AND GOVERNOR 4 26 PROHIBITION. 4 27 1. State agencies, and the board of regents if it desires 4 28 funding other than that provided in section 8.57, subsection 4 29 5, paragraph "c", subparagraph (2), for a vertical 4 30 infrastructure project from the rebuild Iowa infrastructure 4 31 fund, shall submit vertical infrastructure project proposals 4 32 to the commission in accordance with rules established by the 4 33 commission. The commission shall evaluate the proposals and 4 34 recommend to the general assembly which proposals the 4 35 commission believes should be funded based upon the 5 1 comprehensive plan. Proposals shall be contained in a 5 2 separate bill requested by the commission in accordance with 5 3 section 2.16. 5 4 2. The general assembly may consider the bill and may 5 5 remove entire projects from the bill. The general assembly 5 6 shall not add projects to the bill or alter the provisions of 5 7 a project. A project eliminated from the bill by one house of 5 8 the general assembly may again be added to the bill by the 5 9 other house. A vertical infrastructure project shall not be 5 10 eligible for or receive funding from moneys appropriated or 5 11 transferred to the rebuild Iowa infrastructure fund unless the 5 12 project is recommended by the commission prior to action by 5 13 the general assembly and the governor. 5 14 Sec. 7. NEW SECTION. 18.146 ADMINISTRATIVE SUPPORT. 5 15 The department shall provide to the commission 5 16 administrative services and support necessary for the 5 17 commission to accomplish its mission. 5 18 Sec. 8. INITIAL APPOINTMENTS. Of the initial members 5 19 appointed to the commission, four members shall be appointed 5 20 for two-year terms and three members shall be appointed for 5 21 four-year terms. Thereafter, appointments shall be for four- 5 22 year terms. 5 23 Sec. 9. EFFECTIVE DATES. Sections 2 through 8 of this Act 5 24 take effect July 1, 1998. Section 1 of this Act takes effect 5 25 July 1, 1999, except that necessary processes may take place 5 26 before that date for the appropriations for completion of Part 5 27 III of the Iowa communications network. 5 28 EXPLANATION 5 29 This bill amends provisions in section 8.57 regarding the 5 30 rebuild Iowa infrastructure fund. The bill appropriates, 5 31 beginning July 1, 2001, 30 percent of the moneys deposited in 5 32 the fund to the state board of regents for vertical 5 33 infrastructure projects at regents institutions. The bill 5 34 also allows moneys in the fund to be used for completing Part 5 35 III of the Iowa communications network for the 1999-2000 6 1 fiscal year. In addition, the bill provides that moneys in 6 2 the rebuild Iowa infrastructure fund cannot be spent on 6 3 vertical infrastructure projects unless the project is first 6 4 recommended by the rebuild Iowa infrastructure commission 6 5 effective for funding in the fiscal year beginning July 1, 6 6 1999. 6 7 The bill also creates the rebuild Iowa infrastructure 6 8 commission to enhance cooperation among state agencies and 6 9 branches of government regarding the management and protection 6 10 of Iowa's vertical infrastructure. The commission consists of 6 11 seven members appointed by the governor and confirmed by the 6 12 senate who serve staggered four-year terms. The commission is 6 13 to be gender and politically balanced and members are to be 6 14 chosen based upon their knowledge or expertise in the areas of 6 15 architecture, construction, historic preservation, energy 6 16 conservation, finance or accounting, or their interest in 6 17 preserving Iowa's vertical infrastructure. Two members of the 6 18 commission may have a direct or indirect conflict of interest 6 19 in an entity involved or seeking to be involved in a project 6 20 recommended by the commission at the time of appointment. The 6 21 commission shall receive administrative assistance and support 6 22 from the department of general services. Members are allowed 6 23 their actual and necessary expenses incurred in the 6 24 performance of their official duties and a per diem. 6 25 Duties of the commission include developing a comprehensive 6 26 plan for the state's vertical infrastructure facilities, 6 27 evaluating vertical infrastructure projects submitted to the 6 28 commission from state agencies and state agency does not 6 29 include the board of regents, maintaining and updating an 6 30 inventory of state vertical infrastructure facilities, and 6 31 adopting rules relating to the commission's mission and 6 32 duties, including funding eligibility rules for vertical 6 33 infrastructure projects. 6 34 The commission is required to recommend projects for 6 35 approval by the general assembly in bill form by the date 7 1 departmental bills are required to be submitted to the general 7 2 assembly for drafting each year beginning with projects which 7 3 are recommended for funding in the fiscal year beginning July 7 4 1, 1999. If the general assembly takes up the bill, it may 7 5 not add projects to the bill or alter the provisions of 7 6 projects contained in the bill. 7 7 The bill takes effect July 1, 1998, except that provisions 7 8 relating to the making of recommendations and approval of 7 9 vertical infrastructure projects by the commission, general 7 10 assembly, and governor would not be fully effective until July 7 11 1, 1999, and would apply to projects to be funded in the 7 12 fiscal year beginning July 1, 1999. 7 13 LSB 3288XL 77 7 14 jm/jl/8.1
