1 1 Section 1. NEW SECTION. 714.7B WAR RELICS.
1 2 1. A person commits a simple misdemeanor when the person
1 3 takes possession or control of a war relic from a cemetery
1 4 without lawful authority.
1 5 2. A person commits a serious misdemeanor when the person
1 6 sells or attempts to sell a war relic which has been removed
1 7 from a cemetery without lawful authority.
1 8 EXPLANATION
1 9 This bill prohibits a person from taking possession or
1 10 control of a war relic from a cemetery without lawful
1 11 authority. Violation of this prohibition is a simple
1 12 misdemeanor which is punishable by imprisonment not to exceed
1 13 30 days or a fine of at least $50 but not to exceed $100. The
1 14 bill also prohibits a person from selling or attempting to
1 15 sell a war relic which has been removed from a cemetery
1 16 without lawful authority. Violation of this prohibition is a
1 17 serious misdemeanor punishable by a fine of at least $250 but
1 18 not to exceed $1,500 and may additionally include imprisonment
1 19 not to exceed one year.
