PAG LIN 1 1 Section 1. Section 717.1A, unnumbered paragraph 1, Code 1 2 1997, is amended to read as follows: 1 3 A person is guilty of livestock abuse if the person 1 4 intentionally injures or destroys livestock owned by another 1 5 person, in any manner, including, but not limited to, 1 6 intentionally doing any of the following: administering drugs 1 7 or poisons to the livestock, or disabling the livestock by 1 8 using a firearm or trap.A person guilty of livestock abuse1 9commits an aggravated misdemeanor.This section shall not 1 10 apply to any of the following: 1 11 Sec. 2. Section 717.1A, Code 1997, is amended by adding 1 12 the following new unnumbered paragraphs: 1 13 NEW UNNUMBERED PARAGRAPH. A person who commits livestock 1 14 abuse is guilty of an aggravated misdemeanor if the person has 1 15 not previously been convicted of livestock abuse and the acts 1 16 upon which the conviction is based do not involve acts of 1 17 abuse of multiple head of livestock. 1 18 NEW UNNUMBERED PARAGRAPH. A person who commits livestock 1 19 abuse commits a class "D" felony if the person has been 1 20 previously convicted of livestock abuse or if the acts upon 1 21 which the conviction is based involve the abuse of multiple 1 22 head of livestock. 1 23 Sec. 3. Section 717B.2, unnumbered paragraph 1, Code 1997, 1 24 is amended to read as follows: 1 25 A person is guilty of animal abuse if the person 1 26 intentionally injures, maims, disfigures, or destroys an 1 27 animal owned by another person, in any manner, including 1 28 intentionally poisoning the animal.A person guilty of animal1 29abuse is guilty of an aggravated misdemeanor.This section 1 30 shall not apply to any of the following: 1 31 Sec. 4. Section 717B.2, Code 1997, is amended by adding 1 32 the following new unnumbered paragraphs: 1 33 NEW UNNUMBERED PARAGRAPH. A person who commits animal 1 34 abuse is guilty of an aggravated misdemeanor if the person has 1 35 not previously been convicted of animal abuse and the acts 2 1 upon which the conviction is based do not involve the abuse of 2 2 more than one animal. 2 3 NEW UNNUMBERED PARAGRAPH. A person who commits animal 2 4 abuse commits a class "D" felony if the person has been 2 5 previously convicted of animal abuse or if the acts upon which 2 6 the conviction is based involve the abuse of more than one 2 7 animal. 2 8 EXPLANATION 2 9 This bill makes changes to the penalties applicable to 2 10 livestock and animal abuse. Currently, both offenses are 2 11 punishable as aggravated misdemeanors. The bill provides that 2 12 the offenses are aggravated misdemeanors for a first offense 2 13 if the offense did not involve multiple acts of abuse. If the 2 14 person has been previously convicted of that same offense or 2 15 the acts which constituted the offense involved multiple acts 2 16 of abuse, the person is guilty of a class "D" felony. 2 17 An aggravated misdemeanor is punishable by imprisonment not 2 18 to exceed two years and a fine of at least $500 but not more 2 19 than $5,000. A class "D" felony is punishable by imprisonment 2 20 not to exceed five years and a fine of at least $500 but not 2 21 more than $7,500. 2 22 LSB 3925YC 77 2 23 lh/jl/8
