PAG LIN 1 1 Section 1. Section 256.9, subsection 29, Code 1997, is 1 2 amended by striking the subsection. 1 3 Sec. 2. NEW SECTION. 256.29 CENTER FOR CONTINUOUS 1 4 QUALITY IMPROVEMENT. 1 5 1. A center for continuous quality improvement is 1 6 established within the department of education to provide 1 7 school districts with total quality management assistance 1 8 designed to improve overall school district operations. 1 9 2. An Iowa educational excellence partnership is 1 10 established as a facilitating council to assist in 1 11 coordinating and implementing the work of the center for 1 12 continuous quality improvement. The director shall appoint to 1 13 the partnership members who represent school districts, 1 14 accredited nonpublic schools, area education agencies, 1 15 community colleges, colleges and universities, professional 1 16 educational associations, and the business community. 1 17 Sec. 3. Section 257B.1A, Code 1997, is amended by striking 1 18 the section and inserting in lieu thereof the following: 1 19 257B.1A INTEREST FOR IOWA SCHOOLS FUND TRANSFER OF 1 20 INTEREST. 1 21 An interest for Iowa schools fund is established in the 1 22 office of treasurer of state. The department of revenue and 1 23 finance shall deposit interest earned on the permanent school 1 24 fund in the interest for Iowa schools fund. The treasurer 1 25 shall transfer moneys in the interest for Iowa schools fund on 1 26 a quarterly basis as follows: 1 27 1. Fifty-five percent of the moneys deposited in the fund 1 28 to the credit of the center for continuous quality improvement 1 29 as established in section 256.29. 1 30 2. Forty-five percent of the moneys deposited in the fund 1 31 to the credit of the international center endowment fund of 1 32 the international center for gifted and talented education 1 33 established in section 263.8A. 1 34 Sec. 4. NEW SECTION. 261.24 IOWA STATE FAIR SCHOLARSHIP. 1 35 The Iowa state fair scholarship fund is established in the 2 1 office of treasurer of state to be administered by the 2 2 commission. The commission shall adopt rules pursuant to 2 3 chapter 17A for the administration of this section. The rules 2 4 shall provide, at a minimum, that only residents of Iowa who 2 5 have actively participated in the Iowa state fair and 2 6 graduated from an accredited secondary school in Iowa shall be 2 7 eligible to receive an Iowa state fair scholarship for 2 8 matriculation at an eligible institution as defined in section 2 9 261.35. Notwithstanding section 12C.7, interest earned on 2 10 money in the Iowa state fair scholarship fund shall be 2 11 deposited into the fund and may be used by the commission only 2 12 for Iowa state fair scholarship awards. 2 13 Sec. 5. Section 279.51, subsection 4, Code Supplement 2 14 1997, is amended to read as follows: 2 15 4. The department shall seek assistance fromthe first in2 16the nation in education foundation established in chapter 257A2 17and otherfoundations and public and private agencies in the 2 18 evaluation of the programs funded under this section, and in 2 19 the provision of support to school districts in developing and 2 20 implementing the programs funded under this section. 2 21 Sec. 6. FIRST IN THE NATION IN EDUCATION FUND. If 2 22 sections 2, 3, and 7 of this Act are enacted, relating to the 2 23 first in the nation in education foundation, the rights and 2 24 properties of the nonprofit corporation created pursuant to 2 25 section 257A.4, Code 1997, relating to the endowment created 2 26 as the "First In the Nation in Education Fund" pursuant to 2 27 section 257A.7, Code 1997, shall pass to the center for 2 28 continuous quality improvement established in new Code section 2 29 256.29, as created in this Act. However, any debts and other 2 30 financial obligations shall not succeed to the center. 2 31 Sec. 7. Chapter 257A, Code 1997, is repealed. 2 32 EXPLANATION 2 33 This bill abolishes the first in the nation in education 2 34 foundation fund and transfers the rights and properties of the 2 35 foundation relating to its endowment to an entity created in 3 1 the bill, the center for continuous quality improvement. 3 2 The bill repeals the chapter creating the first in the 3 3 nation in education foundation and fund, and any references to 3 4 the foundation. 3 5 The bill requires the college student aid commission to 3 6 administer the Iowa state fair scholarship currently 3 7 administered by the FINE foundation. 3 8 The bill assigns the rights and properties of the FINE 3 9 foundation, while prohibiting the transfer of debt or other 3 10 financial obligation, to the center for continuous quality 3 11 improvement which the bill establishes within the department 3 12 of education. The current distribution in the interest for 3 13 Iowa schools fund, a portion of which supports the FINE 3 14 foundation, is changed to transfer 55 percent of the moneys in 3 15 the fund to the center for continuous quality improvement and 3 16 the remaining 45 percent to the international center for 3 17 gifted and talented education. 3 18 The purpose of the center for continuous quality 3 19 improvement is to provide school districts with total quality 3 20 management assistance designed to improve school operations. 3 21 The bill also creates the Iowa educational excellence 3 22 partnership as a facilitating council to assist in 3 23 coordinating and implementing the work of the center. 3 24 LSB 4208HC 77 3 25 kh/jl/8
