  1  1    Section 1.  Section 135C.16, subsection 1, Code 1997, is
  1  2 amended to read as follows:
  1  3    1.  In addition to the inspections required by sections
  1  4 135C.9 and 135C.38, the department shall make or cause to be
  1  5 made such further unannounced inspections as it deems
  1  6 necessary to adequately enforce this chapter.  At least one
  1  7 general unannounced inspection shall be conducted for each
  1  8 health care facility within a fifteen-month thirty-month
  1  9 period.  In addition, unannounced inspections for nonfederally
  1 10 certified health care facilities shall be based on a risk-
  1 11 based inspections system established by the department.  The
  1 12 inspector shall show identification to the person in charge of
  1 13 the facility and state that an inspection is to be made before
  1 14 beginning the inspection.  An employee of the department who
  1 15 gives unauthorized advance notice of an inspection made or
  1 16 planned to be made under this subsection or section 135C.38
  1 17 shall be disciplined as determined by the director, except
  1 18 that if the employee is employed pursuant to the merit system
  1 19 provisions of chapter 19A the discipline shall not exceed the
  1 20 discipline authorized pursuant to that chapter.
  1 21    Sec. 2.  Section 135C.38, subsection 3, Code 1997, is
  1 22 amended to read as follows:
  1 23    3.  An inspection made pursuant to a complaint filed under
  1 24 section 135C.37 need not be limited to the matter or matters
  1 25 complained of; however,.  However, the inspection shall not be
  1 26 a general inspection unless the complaint inspection coincides
  1 27 with a scheduled general inspection or unless problems in
  1 28 addition to those included in the complaint are visible to the
  1 29 inspector.  Upon arrival at the facility to be inspected, the
  1 30 inspector shall show identification to the person in charge of
  1 31 the facility and state that an inspection is to be made,
  1 32 before beginning the inspection.  Upon request of either the
  1 33 complainant or the department or committee, the complainant or
  1 34 the complainant's representative or both may be allowed the
  1 35 privilege of accompanying the inspector during any on-site
  2  1 inspection made pursuant to this section.  The inspector may
  2  2 cancel the privilege at any time if the inspector determines
  2  3 that the privacy of any resident of the facility to be
  2  4 inspected would otherwise be violated.  The dignity of the
  2  5 resident shall be given first priority by the inspector and
  2  6 others.  
  2  7                           EXPLANATION
  2  8    This bill changes provisions relating to the frequency and
  2  9 scope of inspections of health care facilities conducted by
  2 10 the department of inspections and appeals.  The bill lengthens
  2 11 the time period within which unannounced inspections of each
  2 12 health care facility are required to be made, contained in
  2 13 Code section 135C.16, from the current requirement of one
  2 14 inspection every 15 months to one inspection every 30 months.
  2 15 The bill also adds to Code section 135C.16 the provision that
  2 16 unannounced inspections for nonfederally certified health care
  2 17 facilities shall be based on a risk-based inspections system
  2 18 established by the department.  Additionally, the bill
  2 19 provides that health care facility inspections made pursuant
  2 20 to a complaint may be broadened from the matter or matters
  2 21 initially complained of to a general inspection if problems in
  2 22 addition to those included in the complaint are visible to the
  2 23 inspector during the course of an inspection.
