  2 11    Sec. 3.  Section 96.7, subsection 12, paragraph d, Code
  2 12 1997, is amended to read as follows:
  2 13    d.  This subsection is repealed July 1, 1998 2001, and the
  2 14 repeal is applicable to contribution rates for calendar year
  2 15 1999 2002 and subsequent calendar years.
  2 16    Sec. 4.  Section 96.7, subsection 12, Code 1997, is amended
  2 17 by adding the following new paragraph:
  2 18    NEW PARAGRAPH.  e.  The collection of the administrative
  2 19 contribution surcharge imposed by this subsection shall be
  2 20 suspended for each calendar year for which the director
  2 21 determines that federal legislation provides for the transfer
  2 22 of responsibility for the appropriation of federal
  2 23 unemployment taxes from the federal government to the states.
  2 24 The suspension shall commence at the beginning of the first
  2 25 calendar year following enactment of the federal legislation.
  2 26    Sec. 5.  EFFECTIVE DATE.  This Act takes effect June 30,
  2 27 1998.  
  2 28                           EXPLANATION
  2 29    The bill adds an additional employer contribution rate
  2 30 table to the current eight tables that are used to calculate
  2 31 an employer's liability for unemployment compensation
  2 32 contributions.  The bill also modifies the table used to
  2 33 calculate which rate table is to be used by the department of
  2 34 workforce development in calculating an employer's liability
  2 35 by providing for the use of the ninth table.  The bill then
  3  1 establishes the contribution rates for the ninth contribution
  3  2 rate table.  The ninth table provides for a lower employer
  3  3 contribution rate and would be triggered when the current
  3  4 reserve funds for paying benefits are comparatively the
  3  5 greatest.
  3  6    This bill also amends the provision which would have
  3  7 repealed the employment security administrative contribution
  3  8 surcharge and its fund effective July 1, 1998, to provide for
  3  9 its repeal on July 1, 2001.  In addition, the bill adds a new
  3 10 provision which provides for the suspension of the surcharge
  3 11 for each calendar year following the adoption of federal
  3 12 legislation transferring certain responsibilities related to
  3 13 unemployment contribution appropriations to the states.  The
  3 14 bill provides that the director of the department of workforce
  3 15 development shall make the determination as to whether the
  3 16 federal legislation has been adopted.
  3 17    The bill takes effect June 30, 1998, in order to take
  3 18 effect before the scheduled repeal of Code section 96.7(12)(d)
  3 19 on July 1, 1998.
