PAG LIN 1 1 Section 1. Section 713.3, Code 1997, is amended to read as 1 2 follows: 1 3 713.3 BURGLARY IN THE FIRST DEGREE. 1 4 1. A person commits burglary in the first degree if, while 1 5 perpetrating a burglary in or upon an occupied structure in 1 6 which one or more persons are present,theany of the 1 7 following circumstances apply: 1 8 a. The person has possession of an explosive or incendiary 1 9 device or material, or. 1 10 b. The person has possession of a dangerous weapon, or. 1 11 c. The person intentionally or recklessly inflicts bodily 1 12 injury on any person. 1 13 d. The person performs a sex act with any person which 1 14 would constitute sexual abuse under section 709.1. 1 15 2. Burglary in the first degree is a class "B" felony. 1 16 EXPLANATION 1 17 This bill amends the crime of burglary in the first degree 1 18 to include perpetrating a burglary in or upon an occupied 1 19 structure and performing a sex act with any person which would 1 20 constitute sexual abuse in the first, second, or third degree. 1 21 Burglary in the first degree is a class "B" felony. Class "B" 1 22 felonies are punishable by confinement for no more than 25 1 23 years. 1 24 LSB 4188HC 77 1 25 lh/sc/14
