  1  1    Section 1.  Section 331.802, subsection 2, Code 1997, is
  1  2 amended to read as follows:
  1  3    2.  If a person's death affects the public interest, the
  1  4 county medical examiner shall conduct a preliminary
  1  5 investigation of the cause and manner of death, prepare a
  1  6 written report of the findings, promptly submit the full
  1  7 report to the state medical examiner on forms prescribed for
  1  8 that purpose, and submit a copy of the report to the county
  1  9 attorney.  For each preliminary investigation and the
  1 10 preparation and submission of the required reports, the county
  1 11 medical examiner shall receive from the county of appointment
  1 12 a fee determined by the board plus the examiner's actual
  1 13 expenses.  The fee and expenses paid by the county of
  1 14 appointment shall be paid reimbursed to the county of
  1 15 appointment by the county of the person's residence.  However,
  1 16 if the person's death is caused by a defendant for whom a
  1 17 judgment of conviction and sentence is rendered under section
  1 18 707.2, 707.3, 707.4, 707.5, or 707.6A, the county of the
  1 19 person's residence may recover from the defendant the fee and
  1 20 expenses.  The fee and expenses of the county medical examiner
  1 21 who performs an autopsy or conducts an investigation of a
  1 22 person who dies after being brought into this state for
  1 23 emergency medical treatment by or at the direction of an out-
  1 24 of-state law enforcement officer or public authority shall be
  1 25 paid by the state.  A claim for payment shall be filed with
  1 26 the Iowa department of public health.  
  1 27                           EXPLANATION 
  1 28    This bill establishes a procedure for the collection of
  1 29 fees and expenses incurred by a county medical examiner when a
  1 30 preliminary examination and related services are performed for
  1 31 a decedent who was not a resident of the county.  The county
  1 32 appointing the county medical examiner initially pays for the
  1 33 fees and expenses and the county of appointment is to be
  1 34 reimbursed by the county of the decedent's residence.
