PAG LIN 1 1 Section 1. Section 29C.17, subsection 5, Code 1997, is 1 2 amended to read as follows: 1 3 5. Subject to chapter 24, the commission shall adopt, 1 4 certify, and submit a budget, on or before February 28 of each 1 5 year, to the county board of supervisors and the cities for 1 6 the ensuing fiscal year which will include an itemized list of 1 7 the number of emergency management personnel, their salaries 1 8 and cost of personnel benefits, travel and transportation 1 9 costs, fixed costs of operation, and all other anticipated 1 10 emergency management expenses. The increase in the agency's 1 11 annual budget in a county with a population between one 1 12 hundred sixty-five thousand and one hundred seventy thousand, 1 13 according to the 1990 federal decennial census, is limited to 1 14 an allowable growth rate. The salaries and compensation of 1 15 agency personnelcoming undersubject to the merit system as 1 16 determined by the commissionwillshall include salary 1 17 schedules for classes in which the salary of a class is based 1 18 on merit qualifications for the positions. 1 19 For purposes of this subsection, "allowable growth rate" 1 20 means the percent change, computed to two decimal places, 1 21 between the preliminary price index for the third quarter of 1 22 the calendar year ending just prior to the beginning of the 1 23 fiscal year for which the index is determined and the revised 1 24 price index for the third quarter of the calendar year 1 25 immediately prior to that calendar year, as published in the 1 26 same issue in which such preliminary third quarter price index 1 27 is first published. The price index used shall be the state 1 28 and local government chain-type price index used in the 1 29 quantity and price indexes for gross domestic product, as 1 30 published by the bureau of economic analysis of the United 1 31 States department of commerce in the national income and 1 32 products accounts as published in the survey of current 1 33 business. 1 34 Sec. 2. NEW SECTION. 444.29 EXCEPTION FOR LOCAL 1 35 EMERGENCY MANAGEMENT FUND. 2 1 For a county with a population between one hundred sixty- 2 2 five thousand and one hundred seventy thousand, according to 2 3 the 1990 federal decennial census, moneys, including property 2 4 tax revenues, which are obtained from any source in connection 2 5 with the county emergency management program and which are to 2 6 be deposited in the local emergency management fund pursuant 2 7 to section 29C.17, shall not be limited by the provisions of 2 8 section 444.25B. 2 9 Sec. 3. This Act applies to budgets certified for the 2 10 fiscal years beginning on or after July 1, 1998. 2 11 EXPLANATION 2 12 This bill limits the annual increase in the budget of a 2 13 county emergency management agency to the same price index 2 14 defined under the county property tax limitation for counties 2 15 having a population between 165,000 and 170,000, according to 2 16 the 1990 federal census. 2 17 The bill also exempts from the property tax limitation 2 18 provisions of chapter 444 any moneys deposited by such a 2 19 county into a local emergency management fund which is used to 2 20 fund the county emergency management program. 2 21 The bill applies to budgets certified for fiscal years 2 22 beginning on or after July 1, 1998. 2 23 LSB 2775YC 77 2 24 sc/cf/24
