PAG LIN 1 1 Section 1. Section 135B.7, unnumbered paragraph 2, Code 1 2 1997, is amended to read as follows: 1 3 The rules shall state that a hospital shall not deny 1 4 clinical privileges to physicians and surgeons, podiatric 1 5 physicians, osteopaths, osteopathic surgeons, dentists, or 1 6 certified health service providers in psychology licensed 1 7 under chapter 148, 149, 150, 150A, or 153, or section 154B.7, 1 8 or to physician assistants or advanced registered nurse 1 9 practitioners licensed under chapter 148C or 152, whose 1 10 supervising physician possesses privileges at the hospital, 1 11 solely by reason of the license held by the practitioner or 1 12 solely by reason of the school or institution in which the 1 13 practitioner received medical schooling or postgraduate 1 14 training if the medical schooling or postgraduate training was 1 15 accredited by an organization recognized by the council on 1 16 postsecondary accreditation or an accrediting group recognized 1 17 by the United States department of education. A hospital may 1 18 establish procedures for interaction between a patient and a 1 19 practitioner.Nothing in theThe rules shall not prohibit a 1 20 hospital from limiting, restricting, or revoking clinical 1 21 privileges of a practitioner for violation of hospital rules, 1 22 regulations, or procedures established under this paragraph, 1 23 when applied in good faith and in a nondiscriminatory manner. 1 24Nothing in thisThis paragraph shall not require a hospital to 1 25 expand the hospital's current scope of service delivery solely 1 26 to offer the services of a class of providers not currently 1 27 providing services at the hospital. This paragraph shall not 1 28 permit a hospital to extend clinical privileges to physician 1 29 assistants or advanced registered nurse practitioners unless 1 30 their supervising physician possesses privileges at the 1 31 hospital.Nothing in thisThis section shall not be construed 1 32 to require a hospital to establish rules which are 1 33 inconsistent with the scope of practice established for 1 34 licensure of practitioners to whom this paragraph applies. 1 35 This section shall not be construed to authorize the denial of 2 1 clinical privileges to a practitioner or class of 2 2 practitioners solely because a hospital has as employees of 2 3 the hospital identically licensed practitioners providing the 2 4 same or similar services. 2 5 EXPLANATION 2 6 This bill amends Code section 135B.7 to prohibit a hospital 2 7 from denying clinical privileges to licensed physician 2 8 assistants or licensed advanced registered nurse practitioners 2 9 whose supervising physician possesses privileges at the 2 10 hospital solely by reason of the license held by the physician 2 11 assistant or advanced registered nurse practitioner, or solely 2 12 by reason of the school or institution where the physician 2 13 assistant or advanced registered nurse practitioner was 2 14 trained. 2 15 LSB 2606HC 77 2 16 rn/sc/14.1
