  1  1    Section 1.  Section 455B.306, subsection 8, unnumbered
  1  2 paragraph 1, Code 1997, is amended to read as follows:
  1  3    In addition to the comprehensive plan filed pursuant to
  1  4 subsection 1, a person private agency operating or proposing
  1  5 to operate a sanitary disposal project shall provide a
  1  6 financial assurance instrument to the department prior to the
  1  7 initial approval of a permit or prior to the renewal of a
  1  8 permit for an existing or expanding facility beginning July 1,
  1  9 1988.  
  1 10                           EXPLANATION
  1 11    At present, all city, county, and private operators of
  1 12 sanitary disposal projects shall provide a financial assurance
  1 13 instrument to the department of natural resources prior to the
  1 14 initial approval or renewal of a permit for an existing or
  1 15 expanding facility.  This bill limits this requirement of
  1 16 providing a financial assurance instrument to private
  1 17 operators only.
