1 1 Section 1. NEW SECTION. 225C.51 BILLINGS TO COUNTIES FOR
1 2 DISABILITIES SERVICES.
1 3 1. Unless a billing is delayed due to a disagreement
1 4 between the department and a county concerning the legal
1 5 settlement of a person who received a service listed in
1 6 subsection 2, a county shall not be required to reimburse the
1 7 department for a service listed in subsection 2 which was
1 8 provided more than one hundred twenty days prior to the date
1 9 the department's claim for reimbursement was submitted to the
1 10 county.
1 11 2. The provisions of this section apply to any claim from
1 12 the department for the cost of a service which is payable from
1 13 a county's mental health, mental retardation, and
1 14 developmental disabilities services fund created under section
1 15 331.424A, including but not limited to the following:
1 16 a. Billings for state hospital-school patient charges
1 17 under chapter 222.
1 18 b. Billings for state mental health institute patient
1 19 charges under chapter 230.
1 20 c. Medical assistance claims under sections 249A.12 and
1 21 249A.26.
1 22 EXPLANATION
1 23 This bill relates to department of human services' billings
1 24 to counties for the cost of certain mental health, mental
1 25 retardation, and developmental disability (MH/MR/DD) services.
1 26 New Code section 225C.51 provides that a county is not
1 27 liable for a claim submitted to the county by the department
1 28 more than 120 days after the date the MH/MR/DD service was
1 29 provided. An exception is provided in the event there is a
1 30 dispute between the department and the county concerning legal
1 31 settlement in the county. The provision applies to services
1 32 payable from a county's mental health, mental retardation, and
1 33 developmental disabilities services fund.
