PAG LIN 1 1 Section 1. Section 542B.2, subsection 5, Code 1997, is 1 2 amended by striking the subsection and inserting in lieu 1 3 thereof the following: 1 4 5. a. "Practice of land surveying" includes all of the 1 5 following: 1 6 (1) Providing professional services such as consultation, 1 7 investigation, testimony, evaluation, planning, mapping, and 1 8 assembling. 1 9 (2) Interpreting reliable scientific measurements and 1 10 information relative to the location, size, shape, or physical 1 11 features of the earth, improvements on the earth, the space 1 12 above the earth, or any part of the earth. 1 13 (3) The utilization, development, and interpretation of 1 14 these facts into an orderly survey map. 1 15 b. The practice of land surveying includes, but is not 1 16 limited to, the following: 1 17 (1) Locating, relocating, establishing, reestablishing, 1 18 laying out, or retracing a property line or boundary of a 1 19 tract of land or of a road, right-of-way, easement, alignment, 1 20 or elevation of any of the fixed works embraced within the 1 21 practice of professional engineering. 1 22 (2) Making a survey for the subdivision of a tract of land 1 23 and writing the corresponding legal descriptions. 1 24 (3) Determination, by the use of the principles of land 1 25 surveying, of the position for a survey monument or reference 1 26 point, or setting, resetting, or replacing a survey monument 1 27 or reference point. 1 28 (4) Determination of the configuration or contour of the 1 29 earth's surface or the position of fixed objects on the 1 30 earth's surface by measuring lines and angles and applying the 1 31 principles of mathematics or photogrammetry. 1 32 (5) Geodetic surveying which includes surveying for 1 33 determination of the size and shape of the earth both 1 34 horizontally and vertically and the precise positioning of 1 35 points on the earth utilizing angular and linear measurements 2 1 through spatially oriented spherical geometry. 2 2 (6) Creation, preparation, or modification of electronic 2 3 or computerized data, including land information systems and 2 4 geographic information systems, relative to the performance of 2 5 the activities identified in subparagraphs (1) through (5). 2 6 c. A person is construed to be engaged in or offering to 2 7 be engaged in the practice of land surveying if the person 2 8 does any of the following: 2 9 (1) Engages in land surveying as defined in this section. 2 10 (2) Makes a representation by verbal claim, sign, 2 11 advertisement, letterhead, card, or other manner that the 2 12 person is a land surveyor. 2 13 (3) Uses any title which implies that the person is a land 2 14 surveyor or that the person is licensed under this chapter. 2 15 (4) Represents that they are able to perform, or do 2 16 perform, any service or work included in the practice of land 2 17 surveying as defined in this section. 2 18 EXPLANATION 2 19 This bill adds language to the definition of the practice 2 20 of land surveying. The current definition contained in Code 2 21 section 542B.2 defines land surveying as surveying for the 2 22 correct determination, description, and conveyancing of land, 2 23 the establishment of land boundaries, and the platting of 2 24 lands and subdivisions. The bill expands this definition to 2 25 include a variety of professional consultation and evaluation 2 26 services relative to assembling and interpreting reliable 2 27 scientific measurements and information concerning the 2 28 physical features of any part of the earth. The practice of 2 29 land surveying also includes locating and establishing 2 30 property lines or boundaries of a tract of land, right-of-way, 2 31 easement, alignment, or elevation of any fixed work embraced 2 32 within the practice of professional engineering, surveying of 2 33 subdivisions of tracts of land and writing corresponding legal 2 34 descriptions, determining the position of any survey monument 2 35 or reference point and the configuration or contour of the 3 1 earth's surface or the position of fixed objects on the 3 2 earth's surface by applying the principles of mathematics or 3 3 photogrammetry, and geodetic surveying utilizing spatially 3 4 oriented spherical geometry. Additionally, the practice of 3 5 land surveying encompasses the creation, preparation, or 3 6 modification of computerized data, including land and 3 7 geographic information systems, relative to all of the 3 8 foregoing aspects. The bill also provides that a person is 3 9 construed to be engaged in the practice of land surveying, 3 10 beyond engaging in the above activities, if the person makes a 3 11 verbal or written representation that the person is so 3 12 engaged, or uses a title implying that the person is a land 3 13 surveyor or is licensed under chapter 542B. 3 14 LSB 1117DP 77 3 15 rn/jj/8
