1 1 Section 1. NEW SECTION. 56.44 POLITICAL COMMITTEES –
1 2 RESTRICTIONS ON USE – FUNDRAISING – PENALTIES.
1 3 1. A political committee shall designate its purpose on
1 4 its statement of organization as either in regard to candidate
1 5 elections or in regard to a ballot issue election. A
1 6 political committee shall not be organized with the purpose of
1 7 being involved in both types of elections. A committee formed
1 8 with regard to candidate elections shall not make
1 9 contributions with regard to a ballot issue election, and a
1 10 committee formed with regard to a ballot issue shall not
1 11 contribute with regard to a candidate election.
1 12 2. a. A political committee and the officers of a
1 13 political committee shall use the funds of the committee only
1 14 for expenses consistent with and directly related to the
1 15 designated purposes of the committee, reasonable
1 16 administrative expenses, and contributions to candidates, in
1 17 the case of committees organized with regard to candidate
1 18 elections. Reasonable administrative expenses may include
1 19 payment of wages to administrative personnel, provided that
1 20 the wages are compensation for actual services rendered and
1 21 are at a rate comparable to community standard compensation
1 22 for persons providing similar services.
1 23 b. A political committee shall not use committee funds for
1 24 personal expenses or for the personal benefit of any person.
1 25 3. A political committee, other than a state statutory
1 26 political committee, shall not engage in fundraising through
1 27 telephone solicitation except as authorized by rule, which
1 28 shall be adopted by the board.
1 29 4. If the board determines, after notice and hearing as
1 30 provided in sections 68B.32B and 68B.32C, that a political
1 31 committee other than a statutory political committee has
1 32 committed a violation of this section, the board may, in
1 33 addition to other sanctions provided under sections 56.16 and
1 34 68B.32D, order the committee to dissolve and bar its officers
1 35 from serving as officers of another political committee for a
2 1 period of up to three years.
2 2 EXPLANATION
2 3 This bill adds a new Code section to chapter 56 regarding
2 4 political committees. The new section would require that
2 5 political committees, including statutory political
2 6 committees, be limited in purpose either for candidates or for
2 7 a ballot issue, and that it designate its purpose on its
2 8 statement of organization. The new section also provides
2 9 certain restrictions on use of funds for payment of
2 10 administrative expenses, and for political committees other
2 11 than statutory political committees, on telephone fundraising.
2 12 If these provisions are violated, the ethics and campaign
2 13 disclosure board may order a political committee other than a
2 14 statutory political committee dissolved and prohibit the
2 15 officers from serving as officers of other political
2 16 committees for up to three years.
