2 26 contract with a private company to provide solid waste
2 27 collection services so long as such contract is not entered
2 28 into pursuant to an ordinance which displaces or authorizes
2 29 the displacement of another private company providing solid
2 30 waste collection services at the time the contract is made.
2 31 g. Situations where at least fifty-five percent of the
2 32 property owners in the displacement area petition the
2 33 governing body to take over such solid waste collection
  2 34 services.
  2 35 EXPLANATION
3 1 This bill provides that a city, county, or public agency
3 2 may not displace a private company providing solid waste
3 3 collection services by annexing property, commencing new
3 4 services, or expanding services without deferring displacement
3 5 of the private company for five years after the private
3 6 company has been notified. As an alternative to the five-year
3 7 deferral, a city, county, or public agency may pay a displaced
3 8 private company an amount equal to the company's preceding 12
3 9 months' gross receipts for the provision of solid waste
