1 3 A Resolution to request an interim study regarding the
1 4 use of community service in Iowa's criminal and
1 5 juvenile justice system.
1 6 WHEREAS, the Iowa General Assembly has made
1 7 community service available as part of, in addition
1 8 to, or in lieu of various traditional sentencing or
1 9 dispositional alternatives for criminal acts; and
1 10 WHEREAS, community service is being used by the
1 11 court and the various agencies in Iowa's juvenile and
1 12 adult correctional system in a wide variety of cases
1 13 and for diverse purposes and populations; and
1 14 WHEREAS, other than when community services are
1 15 ordered in lieu of a fine, relatively few specific
1 16 standards exist regarding the purpose, amount, or
1 17 appropriateness of community service work.
1 18 NOW THEREFORE, BE IT RESOLVED BY THE HOUSE OF
1 19 REPRESENTATIVES, That the Legislative Council is
1 20 requested to establish an interim study committee
1 21 consisting of members of both political parties from
1 22 both houses of the general assembly to review the use
1 23 of community service in the Iowa juvenile and criminal
1 24 justice system. The study may include, but is not
1 25 limited to, a review of the underlying public policy
1 26 and purposes for permitting the use of community
1 27 service, the various forms of community services in
1 28 use in this state, the frequency of use of community
1 29 services as an alternative or addition to other forms
1 30 of punishment, the supervision of individuals required
2 1 to perform community services, the uniformity of
2 2 practices relating to any community services
2 3 requirement, and any rules or regulations which have
2 4 been adopted by the state or any political subdivision
2 5 of the state regarding the use or supervision of
2 6 persons performing community services. The committee
2 7 shall submit its findings, together with any
2 8 recommendations, in a report to the General Assembly
2 9 which convenes in January 1998.
