1 1 Section 1. The following amendment to the Constitution of
1 2 the State of Iowa is proposed:
1 3 Article VII of the Constitution of the State of Iowa is
1 4 amended by adding the following new section:
1 5 RACING AND GAMING RECEIPTS. Sec. 10. Net racing and
1 6 gaming receipts, including but not limited to admission fees,
1 7 license fees, wagering taxes, and taxes on gambling games
1 8 received by the state shall be used exclusively for vertical
1 9 infrastructure or for the payment of bonds issued or to be
1 10 issued for vertical infrastructure and such receipts shall be
1 11 deposited into a separate fund in the office of the treasurer
1 12 of state. For purposes of this section, "vertical
1 13 infrastructure" includes only land acquisition and
1 14 construction, major renovation, and major repair of buildings,
1 15 all appurtenant structures, utilities, site development, and
1 16 recreational trails. "Vertical infrastructure" does not
1 17 include routine, recurring maintenance or operational expenses
1 18 or leasing of a building, appurtenant structure, or utility
1 19 without a lease-purchase agreement.
1 20 Sec. 2. The foregoing amendment to the Constitution of the
1 21 State of Iowa is referred to the General Assembly to be chosen
1 22 at the next general election for members of the General
1 23 Assembly and the Secretary of State is directed to cause the
1 24 same to be published for three consecutive months previous to
1 25 the date of that election as provided by law.
1 26 EXPLANATION
1 27 This joint resolution proposes an amendment to the Iowa
1 28 Constitution which would require that all racing and gaming
1 29 receipts received by the state be used exclusively for
1 30 vertical infrastructure or payment of bonds issued for
1 31 vertical infrastructure. "Racing and gaming receipts"
1 32 includes admission fees, license fees, and taxes on wagering
1 33 at tracks and on gambling games. "Vertical infrastructure"
1 34 means the same as is defined in section 8.57, subsection 5,
1 35 paragraph "c", Code 1997, and includes the acquisition of land
2 1 and construction, major renovation, and major repair of
2 2 buildings, appurtenant structures, utilities, site
2 3 development, and recreational trails.
2 4 The resolution, if adopted, would be referred to the next
2 5 general assembly for its consideration before being submitted
2 6 to the electorate for ratification.
