1 1 Section 1. SINGLE CONTACT REPOSITORY. There is
1 2 appropriated from lottery revenues received during the fiscal
1 3 year beginning July 1, 1994, which remain in the lottery fund
1 4 following the transfers made pursuant to 1995 Iowa Acts,
1 5 chapter 220, section 16, 1996 Iowa Acts, chapter 1219, section
1 6 14, and 1997 Iowa Acts, chapter 209, section 10, to the
1 7 department of general services, division of information
1 8 technology services, for the fiscal year beginning July 1,
1 9 1998, and ending June 30, 1999, the following amount, or so
1 10 much thereof as is necessary, to be used for the purposes
1 11 designated:
1 12 For development and other start-up costs to establish a
1 13 single contact repository implementing the provisions of this
1 14 Act and the first year operational costs of the repository:
1 15 .................................................. $ 125,000
1 16 The department of inspections and appeals shall provide
1 17 direction to the division for implementation of the single
1 18 contact repository.
1 19 Sec. 2. Section 135C.33, Code Supplement 1997, is amended
1 20 by adding the following new subsection 1 and renumbering the
1 21 succeeding subsections:
1 22 NEW SUBSECTION. 1. For the purposes of this section, in
1 23 addition to the meaning defined for this chapter, "facility"
1 24 or "facility licensed under this chapter" includes all of the
1 25 following:
1 26 a. An elder group home certified under chapter 231B.
1 27 b. An assisted living facility certified or voluntarily
1 28 accredited under chapter 231C.
1 29 c. A provider of homemaker, home-health aide, home-care
1 30 aide, or adult day care services.
1 31 d. A hospice.
1 32 e. A provider of services under a federal medical
1 33 assistance home and community-based services waiver.
1 34 Sec. 3. Section 135C.33, Code Supplement 1997, is amended
1 35 by adding the following new subsection:
2 1 NEW SUBSECTION. 5. The department of inspections and
2 2 appeals, in conjunction with other departments and agencies of
2 3 state government involved with criminal history and abuse
2 4 registry information, shall establish a single contact
2 5 repository for facilities licensed under this chapter to have
2 6 electronic access to data to perform background checks for
2 7 purposes of employment.
2 8 Sec. 4. Section 692A.13, Code 1997, is amended by adding
2 9 the following new subsection:
2 10 NEW SUBSECTION. 9. The department shall provide
2 11 information for purposes of the single contact repository
2 12 established pursuant to section 135C.33, in accordance with
2 13 rules adopted by the department.
2 14 EXPLANATION
2 15 This bill relates to employment background checks by health
2 16 care facilities and services and creates a single contact
2 17 repository for access to data to obtain background
2 18 information. In addition, the bill provides an appropriation
2 19 to the department of general services for initial and
2 20 operating costs for the repository.
2 21 Code section 135C.33, relating to required abuse
2 22 information and criminal records checks for employment in
2 23 health care facilities licensed under Code chapter 135C, is
2 24 amended to require the checks of employees of elder group
2 25 homes, certified or accredited assisted living facilities,
2 26 providers of homemaker, home-health aide, home-care aide, and
2 27 adult day care services, hospices, and providers of services
2 28 under a federal medical assistance home and community-based
2 29 waiver services.
2 30 The bill directs the department of inspections and appeals
2 31 to work with other departments of state government in
2 32 establishing a single contact repository for these facilities
2 33 to electronically access data for performing the background
2 34 checks.
2 35 Code section 692A.13 is amended to direct the department of
3 1 public safety to provide sex offender registry information as
3 2 part of the single contact repository.
