PAG LIN 1 1 Section 1. Section 299.1B, Code 1997, is amended to read 1 2 as follows: 1 3 299.1B FAILURE TO ATTEND LOSS OF DRIVER'S LICENSE. 1 4 A person who does not attend a public school, an accredited 1 5 nonpublic school, competent private instruction in accordance 1 6 with the provisions of chapter 299A, an alternative school, or 1 7 adult education classes, or who is not employed at least1 8twenty hours per weekshall not receive a motor vehicle 1 9 operator's license until age eighteen unless the person has 1 10 graduated or obtained a high school equivalency diploma. A 1 11 person under age eighteen who has been issued a motor vehicle 1 12 operator's license who does not attend a public school, an 1 13 accredited nonpublic school, competent private instruction in 1 14 accordance with the provisions of chapter 299A, an alternative 1 15 school, or adult education classes and who has not graduated 1 16 or obtained a high school equivalency diploma, shall surrender 1 17 the license and be issued a temporary restricted license under 1 18 section 321.215. 1 19 Sec. 2. Section 321.177, subsection 1, Code 1997, is 1 20 amended to read as follows: 1 21 1. To any person who is under the age of eighteen years, 1 22without the person's first havingunless the person meets the 1 23 requirements established in section 299.1B and has 1 24 successfully completed an approved driver education course, in 1 25 which case, the minimum age is sixteen years. However, the 1 26 department may issue a driver's license to certain minors as 1 27 provided in section 321.194, an instruction permit as provided 1 28 in section 321.180, subsection 1, or a driver's license 1 29 restricted to motorized bicycles as provided in section 1 30 321.189, subsection 8. 1 31 Sec. 3. Section 321.178, subsection 1, unnumbered 1 32 paragraph 5, Code 1997, is amended to read as follows: 1 33 Any person who successfully completes an approved driver 1 34 education course at a private or commercial driver education 1 35 school licensed by the department, shall likewise be eligible 2 1 for a driver's license at the age of sixteen years,providing2 2 provided that the instructor in charge of the student's 2 3 training has satisfied the educational requirements for a 2 4 teaching certificate at the secondary level and holds a valid 2 5 certificate to teach driver education in the public schools of 2 6 Iowa and the student has met the requirements of section 2 7 299.1B. 2 8 Sec. 4. Section 321.178, subsection 3, paragraph b, Code 2 9 1997, is amended by adding the following new subparagraph: 2 10 NEW SUBPARAGRAPH. (5) The minor must meet the 2 11 requirements of section 299.1B. 2 12 Sec. 5. Section 321.180, subsection 1, paragraph a, 2 13 unnumbered paragraph 1, Code 1997, is amended to read as 2 14 follows: 2 15 A person who is at least fourteen years of age, who meets 2 16 the requirements in section 299.1B, and who, except for the 2 17 person's lack of instruction in operating a motor vehicle, 2 18 would be qualified to obtain a driver's license, shall, upon 2 19 meeting the requirements of section 321.186 other than a 2 20 driving demonstration, and upon paying the required fee, be 2 21 issued an instruction permit by the department. Subject to 2 22 the limitations in this subsection, an instruction permit 2 23 entitles the permittee, while having the permit in the 2 24 permittee's immediate possession, to operate a motor vehicle, 2 25 other than a commercial motor vehicle or as a chauffeur or a 2 26 motor vehicle with a gross vehicle weight rating of sixteen 2 27 thousand one or more pounds, upon the highways for a period 2 28 not to exceed two years from the licensee's birthday 2 29 anniversary in the year of issuance. If the applicant for an 2 30 instruction permit holds a driver's license issued in this 2 31 state valid for the operation of a motorized bicycle or a 2 32 motorcycle, the instruction permit shall be valid for such 2 33 operation without the need of an accompanying person. 2 34 EXPLANATION 2 35 This bill provides that, in order to be eligible for a 3 1 motor vehicle license, a person who is under the age of 18 3 2 must be attending school or competent private instruction or 3 3 have graduated or obtained a high school equivalency diploma. 3 4 LSB 4050HH 77 3 5 lh/jw/5
