1 1 Section 1. RECOVERY OF FAMILY INVESTMENT PROGRAM
1 2 ASSISTANCE. Subject to all of the following provisions and
1 3 notwithstanding the restrictions in section 239B.11, the
1 4 department of human services may expend recovered moneys
1 5 deposited in the family investment program account under
1 6 section 239B.14 during the fiscal year beginning July 1, 1998,
1 7 for expanded fraud and recoupment activities under the family
1 8 investment program by the departments of human services and
1 9 inspections and appeals:
1 10 1. The director of human services determines that the
1 11 expenditures can reasonably be expected to increase recovery
1 12 of fraudulently obtained family investment program assistance
1 13 in excess of the amount recovered in the 1997-1998 fiscal
1 14 year.
1 15 2. The amount expended for the expanded fraud and
1 16 recoupment activities shall not exceed the amount of the
1 17 projected increase in assistance recovered.
1 18 EXPLANATION
1 19 This bill authorizes the director of human services to
1 20 expend moneys recovered from persons who fraudulently obtained
1 21 family investment program assistance for expanded fraud and
1 22 recoupment activities. Under Code section 239B.14, these
1 23 moneys are to be deposited in the family investment program
1 24 account. The bill provides that the requirements in Code
1 25 section 239B.11 for the moneys in the account to be used for
1 26 providing assistance and for other program expenditures are
1 27 not applicable for the purposes in the bill.
1 28 The authorization is provided for fiscal year 1998-1999 and
1 29 is subject to the following conditions: the director
1 30 determines the expenditures can reasonably be expected to
1 31 increase recovery of assistance in excess of the amount
1 32 recovered in the 1997-1998 fiscal year and the amount expended
1 33 does not exceed the amount of the projected increase.
