1 1 Section 1. NEW SECTION. 68B.5B STATE AND LOCAL
1 2 GOVERNMENT AGENCIES LOBBYISTS PROHIBITIONS.
1 3 1. A person who is not an employee or official of the
1 4 state shall not receive compensation from an agency of state
1 5 government for purposes of engaging in state lobbying.
1 6 2. A person who is not an employee or official of a
1 7 political subdivision of the state shall not receive
1 8 compensation from the political subdivision for purposes of
1 9 engaging in state lobbying.
1 10 3. For purposes of this section:
1 11 a. "Agency of state government" means an agency of state
1 12 government as defined in section 68B.2 but also includes any
1 13 agricultural commodity promotional board which is subject to a
1 14 producer referendum.
1 15 b. "Political subdivision" means a political subdivision,
1 16 authority, enterprise, operation, office, or department of the
1 17 state which is authorized under the laws of the state to
1 18 exercise the power to levy or which receives funding from
1 19 revenue from any tax.
1 20 c. "State lobbying" means encouraging the passage, defeat,
1 21 approval, veto, or modification of legislation, a rule, or an
1 22 executive order by the general assembly, an agency of state
1 23 government, or any statewide elected official.
1 24 Sec. 2. CONSTRUCTION. Section 1 of this Act shall not be
1 25 construed to limit or impair the speech or advocacy of any
1 26 member of an agency of state government or a political
1 27 subdivision but shall be construed to prohibit the use of tax
1 28 revenue to pay for state lobbying by persons other than
1 29 officials or employees of state government.
1 30 EXPLANATION
1 31 The bill prohibits persons who are not officials or
1 32 employees of the state from receiving compensation for
1 33 purposes of engaging in state lobbying. The bill also
1 34 prohibits persons who are not officials or employees of
1 35 political subdivisions of the state from receiving
2 1 compensation for purposes of engaging in state lobbying for a
2 2 political subdivision.
2 3 State lobbying is defined under the bill as encouraging the
2 4 passage, defeat, approval, veto, or modification of
2 5 legislation, a rule, or an executive order by the general
2 6 assembly, an agency of state government, or any statewide
2 7 elected official.
2 8 Violations of the bill are a serious misdemeanor under Code
2 9 section 68B.25. Persons convicted of a serious misdemeanor
2 10 must pay a fine of at least $250 but not more than $1,500 and
2 11 may be ordered to serve a term of imprisonment not to exceed
2 12 one year.
