  1  1    Section 1.  Section 97B.41, subsection 8, paragraph b,
  1  2 subparagraph (6), Code 1997, is amended to read as follows:
  1  3    (6)  Employees hired for temporary employment of less than
  1  4 six months or one thousand forty hours in a calendar year.  An
  1  5 employee who works for an employer for six or more months in a
  1  6 calendar year or who works for an employer for more than one
  1  7 thousand forty hours in a calendar year is not a temporary
  1  8 employee under this subparagraph.  Adjunct instructors are
  1  9 temporary employees for the purposes of this chapter.  As used
  1 10 in this section, unless the context otherwise requires,
  1 11 "adjunct instructors" means instructors employed by a
  1 12 community college or a university governed by the state board
  1 13 of regents without a continuing contract, whose teaching load
  1 14 does not exceed one-half time for two full semesters or three
  1 15 full quarters per calendar year.
  1 16    Sec. 2.  Section 97B.41, subsection 8, paragraph b, Code
  1 17 1997, is amended by adding the following new subparagraph:
  1 18    NEW SUBPARAGRAPH.  (6A)  Adjunct instructors unless an
  1 19 adjunct instructor elects by filing an application with the
  1 20 department to be covered under this chapter.  As used in this
  1 21 section, unless the context otherwise requires, "adjunct
  1 22 instructors" means instructors employed by a community college
  1 23 or a university governed by the state board of regents without
  1 24 a continuing contract, whose teaching load does not exceed
  1 25 one-half time for two full semesters or three full quarters
  1 26 per calendar year.
  1 27    Sec. 3.  IOWA PUBLIC EMPLOYEES' RETIREMENT SYSTEM –
  1 28 ADJUNCT INSTRUCTORS – OPTIONAL COVERAGE – PURCHASE OF
  1 29 SERVICE CREDIT.
  1 30    1.  Notwithstanding the provisions of section 97B.41 (Code
  1 31 1997) or 97B.42A (Code 1997) to the contrary, an adjunct
  1 32 instructor as defined in section 97B.41 who is employed as an
  1 33 adjunct instructor as of July 1, 1998, may elect to be covered
  1 34 under the Iowa public employees' retirement system if the
  1 35 person files an application with appropriate documentation
  2  1 with the department of personnel to elect coverage on or
  2  2 before July 1, 1999.
  2  3    2.  An adjunct instructor who elects to be covered under
  2  4 the Iowa public employees' retirement system by July 1, 1999,
  2  5 pursuant to this section may purchase service credit as
  2  6 provided in this subsection.  A person may purchase credit,
  2  7 using the procedure prescribed in section 97B.73, for one or
  2  8 more quarters of service prior to July 1, 1998, in which the
  2  9 person was employed as an adjunct instructor as described in
  2 10 this subsection.  
  2 11                           EXPLANATION
  2 12    This bill provides that a newly hired adjunct instructor at
  2 13 a community college or a regents university may elect to be
  2 14 covered under the Iowa public employees' retirement system
  2 15 pursuant to the requirements of Code section 97B.42A.  The
  2 16 bill also provides that adjunct instructors employed as of
  2 17 July 1, 1998, may elect to be covered by filing an application
  2 18 to be covered by July 1, 1999.  The bill provides that a
  2 19 currently employed adjunct instructor may purchase additional
  2 20 service credit under IPERS for each quarter or quarters the
  2 21 instructor was employed as an adjunct instructor prior to July
  2 22 1, 1998.
