PAG LIN 1 1 Section 1. Section 298.2, Code Supplement 1997, is amended 1 2 by adding the following new subsection: 1 3 NEW SUBSECTION. 7. There is appropriated annually from 1 4 the general fund of the state to the department of management 1 5 for the school budget year beginning July 1, 1998, and 1 6 succeeding budget years, an amount sufficient to equalize the 1 7 regular physical plant and equipment levy across all school 1 8 districts having imposed the regular levy at the rate of one 1 9 hundred twenty-eight dollars per pupil. The funds 1 10 appropriated shall be allocated as follows: 1 11 a. For each school district which has imposed the regular 1 12 physical plant and equipment levy pursuant to this section for 1 13 the budget year, the department of management shall, by April 1 14 15 of the base year, determine whether, and the amount by 1 15 which, the regular physical plant and equipment levy property 1 16 tax revenue generated in the school district for the budget 1 17 year falls below the amount of one hundred twenty-eight 1 18 dollars per pupil. In making this determination, the 1 19 department shall utilize the most recent figures available for 1 20 the district's valuation of taxable property and the actual 1 21 enrollment certified to the department by the department of 1 22 education for the base year. 1 23 b. If it is determined that the property tax revenue 1 24 generated by the regular physical plant and equipment levy for 1 25 a school district is less than one hundred twenty-eight 1 26 dollars per pupil, the department of management shall deposit, 1 27 for each school district experiencing a shortfall, an amount 1 28 equal to the difference between the amount of revenue 1 29 generated by the school district pursuant to the regular 1 30 physical plant and equipment levy and the figure of one 1 31 hundred twenty-eight dollars per pupil, to the credit of the 1 32 district in the physical plant and equipment levy fund by 1 33 September 15 of the budget year. Amounts credited shall be 1 34 added to the revenue generated from the regular and, if 1 35 applicable, voter-approved physical plant and equipment levies 2 1 as provided in this section and expended as provided in 2 2 section 298.3. 2 3 EXPLANATION 2 4 This bill provides for an annual appropriation from the 2 5 general fund of the state to the department of management 2 6 sufficient to equalize the regular physical plant and 2 7 equipment levy across all school districts having imposed the 2 8 levy at the rate of $128 per pupil. The department of 2 9 management shall determine by April 15 each year, for school 2 10 districts which have imposed the regular physical plant and 2 11 equipment levy, whether, and the amount by which, the revenue 2 12 generated by the levy falls below $128 per pupil. In making 2 13 this determination, the department shall utilize the most 2 14 recent figures available for the district's valuation of 2 15 taxable property and the actual enrollment certified to the 2 16 department by the department of education for the prior year. 2 17 For school districts having imposed the levy and determined 2 18 to have a revenue shortfall, the department of management 2 19 shall deposit an amount equal to the difference between the 2 20 amount of revenue generated by the school district pursuant to 2 21 the regular physical plant and equipment levy and the figure 2 22 of $128 per pupil, to the credit of the district in the 2 23 physical plant and equipment levy fund. Amounts so credited 2 24 shall be added to the regular and, if applicable, voter- 2 25 approved physical plant and equipment levy revenue and 2 26 expended as provided in Code section 298.3. 2 27 LSB 3334YH 77 2 28 rn/cf/24
