PAG LIN 1 1 Section 1. NEW SECTION. 461A.81 PARK USER PERMIT – OUT- 1 2 OF-STATE MOTOR VEHICLES. 1 3 1. A person shall not park or permit to be parked a motor 1 4 vehicle on land under the jurisdiction of the department where 1 5 a park user permit is required pursuant to this section, 1 6 unless the motor vehicle has a park user permit attached to or 1 7 displayed on the motor vehicle as provided in this section. 1 8 2. The commission may establish, by rule adopted pursuant 1 9 to chapter 17A, a park user permit system which shall apply to 1 10 land under the jurisdiction of the department as designated by 1 11 the commission. The rules shall set the permit fee, specify 1 12 the procedures for sale and distribution of the permits, 1 13 provide for the display of a permit, and determine other 1 14 matters deemed necessary for the effective administration of 1 15 the permit system. The receipts from the permit fees shall be 1 16 credited to the state conservation fund. 1 17 3. This section does not apply to the following motor 1 18 vehicles: 1 19 a. A motor vehicle which is registered pursuant to chapter 1 20 321. 1 21 b. An official government vehicle operated by a state, 1 22 county, city, school district, or federal employee or agent 1 23 while in performance of official business. 1 24 c. A motor vehicle moving on a public road within or that 1 25 crosses state land to which this section applies. 1 26 4. A person who parks or permits to be parked a motor 1 27 vehicle on land under the jurisdiction of the department in 1 28 violation of the requirements of this section is guilty of a 1 29 simple misdemeanor which is punishable by a scheduled fine 1 30 specified in section 805.8, subsection 6, paragraph "a". 1 31 Sec. 2. Section 805.8, subsection 6, paragraph a, Code 1 32 Supplement 1997, is amended to read as follows: 1 33 a. For violations under sections 461A.39, 461A.45,and1 34 461A.50, and 461A.81, the scheduled fine is ten dollars. 1 35 Sec. 3. EFFECTIVE DATE. This Act takes effect January 1, 2 1 1999. 2 2 EXPLANATION 2 3 This bill authorizes the natural resource commission of the 2 4 department of natural resources to establish a park user 2 5 permit system for forests, parks, and recreation areas which 2 6 the commission designates. The park permit user system will 2 7 apply to out-of-state registered motor vehicles only. The 2 8 park user permits do not apply to motor vehicles registered in 2 9 Iowa pursuant to chapter 321. 2 10 If the natural resource commission decides to impose a user 2 11 permit system on the land under its jurisdiction, the 2 12 commission will determine which properties will be affected by 2 13 the permits, the amount of the fee, and other necessary 2 14 administrative details. Receipts from state permits will be 2 15 credited to the state conservation fund. 2 16 The penalty for violations is a scheduled fine of $10. 2 17 This bill takes effect January 1, 1999. 2 18 LSB 4010HH 77 2 19 tj/jw/5.1
