  1  1    Section 1.  Section 321.11, unnumbered paragraph 3, Code
  1  2 Supplement 1997, is amended to read as follows:
  1  3    Notwithstanding other provisions of this section to the
  1  4 contrary, the department shall not release personal
  1  5 information to a person, other than to an officer or employee
  1  6 of a law enforcement agency, an employee of a federal or state
  1  7 agency or political subdivision, a contract employee of the
  1  8 department of inspections and appeals in the conduct of an
  1  9 investigation, or a licensed private investigation agency or a
  1 10 licensed security service or a licensed employee of either, if
  1 11 the information is requested by the presentation of a
  1 12 registration plate number.  However, In addition, an officer
  1 13 or employee of a law enforcement agency may release the name,
  1 14 address, and telephone number of a motor vehicle registrant to
  1 15 a person requesting the information by the presentation of a
  1 16 registration plate number if the officer or employee of the
  1 17 law enforcement agency believes that the release of the
  1 18 information is necessary to prevent an unlawful act in the
  1 19 performance of the officer's or employee's duties.  A person
  1 20 seeking the information shall state in writing the nature of
  1 21 the unlawful act that the person is attempting to prevent.  
  1 22                           EXPLANATION
  1 23    This bill permits an employee of a federal or state agency
  1 24 or political subdivision or a contract employee of the
  1 25 department of inspections and appeals in the conduct of an
  1 26 investigation to obtain personal information within the
  1 27 control of the department of transportation based upon the
  1 28 presentation of a registration plate number to the department
  1 29 of transportation.  The bill also authorizes an officer or
  1 30 employee of a law enforcement agency to release vehicle
  1 31 registration information if the release is necessary in the
  1 32 performance of law enforcement agency officer's or employee's
  1 33 duties.
  1 34    Current law permits only law enforcement agencies, licensed
  1 35 security services, and private investigation agencies to
  2  1 obtain this information from the department of transportation.
