1 1 Section 1. Section 811.2, subsection 1, Code 1997, is
1 2 amended by adding the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. Any bailable defendant who is
1 4 charged with unlawful possession, manufacture, delivery, or
1 5 distribution of a controlled substance or other drug under
1 6 chapter 124 or 125 and is ordered released shall be required,
1 7 as a condition of that release, to submit to a substance abuse
1 8 evaluation and follow any recommendations proposed in the
1 9 evaluation for appropriate substance abuse treatment.
1 10 EXPLANATION
1 11 This bill requires that any bailable defendant who is
1 12 charged with unlawful possession, manufacture, delivery, or
1 13 distribution of a controlled substance or other drug under
1 14 chapter 124 or 125 and who is released to submit to a
1 15 substance abuse evaluation and follow any treatment
1 16 recommendations made in the evaluation. Submission to the
1 17 evaluation and compliance with the treatment recommendations
1 18 are made a condition of the defendant's release.
