  1  1    Section 1.  Section 331.361, Code Supplement 1997, is
  1  2 amended by adding the following new subsection:
  1  3    NEW SUBSECTION.  8.  a.  An official shall not participate
  1  4 in, or receive directly or indirectly any money or valuable
  1  5 thing from, horse racing, pari-mutuel wagering, or gambling
  1  6 games on county property which has been approved by the state
  1  7 racing and gaming commission for gambling activities.
  1  8    b.  As used in this subsection, "official" means one or
  1  9 more of the following:
  1 10    (1)  A member of the county board of supervisors of a
  1 11 county that owns the approved county property.
  1 12    (2)  A member of the board of directors of a nonprofit
  1 13 corporation having an agreement with a county board of
  1 14 supervisors for the use of approved county property under a
  1 15 license issued by the state racing and gaming commission.
  1 16    (3)  A spouse or child of a person described in
  1 17 subparagraph (1) or (2).
  1 18    c.  An official who knowingly violates the provisions of
  1 19 paragraph "a" is guilty of a serious misdemeanor and may be
  1 20 removed from public office or as an officer or director of an
  1 21 affected nonprofit corporation.  
  1 22                           EXPLANATION
  1 23    This bill prohibits officials from having a conflict of
  1 24 interest by engaging in pari-mutuel wagering, horse racing, or
  1 25 gambling games on county property approved by the state racing
  1 26 and gaming commission.  "An official" is defined to include a
  1 27 member of a county board of supervisors or a member of a
  1 28 nonprofit corporation board of directors having an agreement
  1 29 with a county board of supervisors to use approved county
  1 30 property for licensed gambling purposes.  It also includes a
  1 31 spouse and children of an official.
  1 32    An official who knowingly violates the prohibition of
  1 33 having a financial interest in pari-mutuel horse racing or
  1 34 gambling games is guilty of a serious misdemeanor and may be
  1 35 removed from public or corporate office.  A serious
  2  1 misdemeanor is punishable by a fine of not less than $250 nor
  2  2 more than $1,500.  The court may also order imprisonment of
  2  3 not more than one year.
