PAG LIN 1 1 Section 1. Section 256.38, Code 1997, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 3. The penalty provided for in section 1 4 92.20 shall not be applied to a parent, guardian, or person in 1 5 charge of a student, and the provisions of chapter 92 shall 1 6 not apply to a student, if the student is at least sixteen 1 7 years of age and is employed under a school-to-work or career 1 8 pathways program, in accordance with this section or section 1 9 256.39, through the administration of the school district or a 1 10 district attendance center and any of the following conditions 1 11 apply: 1 12 a. The work of a student participating in an occupation 1 13 under a school-to-work or career pathways program, which has 1 14 been declared particularly hazardous pursuant to chapter 92, 1 15 is incidental to the student's training. 1 16 b. The work of the student is intermittent and for short 1 17 periods of time and is under the direct and close supervision 1 18 of the employer participant of the program as a necessary part 1 19 of school-to-work or career pathways training. 1 20 c. The work involves other duties, including as helper or 1 21 assistant and similar assignments while under the close 1 22 supervision of an experienced employee and the work has not 1 23 been declared particularly hazardous pursuant to chapter 92. 1 24 Sec. 2. CONTINGENT EFFECTIVE DATE. This Act takes effect 1 25 when the director of the department of workforce development 1 26 certifies to the general assembly that the Act does not 1 27 conflict with federal law or certifies to the general assembly 1 28 that the secretary of labor of the United States, or the 1 29 secretary's designee, has approved the Act. 1 30 EXPLANATION 1 31 This bill makes child labor laws in the Code inapplicable 1 32 if a student is at least 16 years of age and is employed under 1 33 a school-to-work or career pathways program through a school's 1 34 administration and any of the following conditions apply: The 1 35 work of a student in an occupation declared particularly 2 1 hazardous by the labor commissioner is incidental to the 2 2 student's training; the work of the student is intermittent 2 3 and for short periods of time and is under the direct and 2 4 close supervision of the employer participant of the program 2 5 as a necessary part of training; the work involves other 2 6 duties, including as helper or assistant and similar 2 7 assignments while under the close supervision of an 2 8 experienced employee and the work has not been declared 2 9 particularly hazardous. 2 10 LSB 3402HH 77 2 11 kh/jl/8
