  1  1    Section 1.  Section 509A.13A, subsection 1, paragraph b,
  1  2 subparagraph (2), subparagraph subdivision (a), Code 1997, is
  1  3 amended to read as follows:
  1  4    (a)  Meeting the requirements for receiving retirement
  1  5 benefits pursuant to chapter 97B based upon having attained at
  1  6 least sixty-two years of age and upon having completed at
  1  7 least thirty years of membership service retirement at the
  1  8 employee's normal retirement date as provided in section
  1  9 97B.45.
  1 10    Sec. 2.  RETROACTIVE APPLICABILITY.  This Act is
  1 11 retroactively applicable to July 1, 1994, and is applicable on
  1 12 and after that date.  
  1 13                           EXPLANATION 
  1 14    This bill amends the provisions concerning the eligibility
  1 15 of a surviving spouse of a state employee who retired under
  1 16 IPERS and who elected to continue coverage under the state's
  1 17 group health care plan until the employee's death.  Currently,
  1 18 to be eligible, the retired state employee had to have retired
  1 19 at age 62 with at least 30 years of service under IPERS.  The
  1 20 bill provides that a surviving spouse will be eligible so long
  1 21 as the retired state employee retired upon the employee's
  1 22 normal retirement date.  Under current law, the normal
  1 23 retirement date for those retiring on or after July 1, 1997,
  1 24 is defined to include the first month in which the combination
  1 25 of the employee's years of service and age, so long as the
  1 26 member is at least 55 years of age, equals 88.
  1 27    The bill provides that the change is retroactively
  1 28 applicable to July 1, 1994.
