PAG LIN 1 1 Section 1. NEW SECTION. 331.424C MENTAL HEALTH, MENTAL 1 2 RETARDATION, AND DEVELOPMENTAL DISABILITIES SERVICES 1 3 SUPPLEMENTAL LEVY. 1 4 1. To the extent that the levy for the services fund under 1 5 section 331.424A and any other revenues available for 1 6 expenditure in the services fund are insufficient to meet the 1 7 county's need for services under section 331.424A, the board 1 8 of supervisors may certify a supplemental levy as provided in 1 9 this section. 1 10 2. a. If recommended and approved in accordance with 1 11 paragraph "b" for each fiscal year, to the extent not included 1 12 by the county in the levy under section 331.424A, a 1 13 supplemental levy under this section is authorized for the 1 14 amount of the costs projected to be in excess of revenues 1 15 available for expenditure in the services fund for the fiscal 1 16 year associated with the county's implementation of the 1 17 county's management plan for mental health, mental 1 18 retardation, and developmental disabilities services in 1 19 accordance with section 331.439, subsection 1, paragraphs "b", 1 20 "c", and "d". 1 21 b. If the county board of supervisors projects that 1 22 revenues available for expenditure in the county's services 1 23 fund under section 331.424A for the succeeding fiscal year 1 24 will be insufficient to pay all of the costs chargeable to the 1 25 services fund in the succeeding fiscal year, the board may 1 26 annually certify a levy under this section for the amount of 1 27 the costs described in paragraph "a" provided all of the 1 28 following conditions are met: 1 29 (1) The board of supervisors submits a request for review 1 30 of the county's projected revenues and expenditures for the 1 31 services fund to the state-county management committee and the 1 32 committee concurs that the projections are reasonable. 1 33 (2) Following the concurrence of the state-county 1 34 management committee under subparagraph (1), the board of 1 35 supervisors adopts a resolution authorizing a supplemental 2 1 levy under this section for the costs described in paragraph 2 2 "a" and the resolution specifies the amount of costs to be 2 3 raised by the levy. 2 4 3. Property tax dollars levied under this section shall be 2 5 deposited into the county's services fund created in section 2 6 331.424A. 2 7 Sec. 2. APPLICABILITY. The levy authority in section 2 8 331.424C as enacted by this Act first applies to taxes payable 2 9 in the fiscal year beginning July 1, 1999. 2 10 EXPLANATION 2 11 This bill authorizes under certain circumstances a county 2 12 to certify a supplemental levy on an annual basis for excess 2 13 costs associated with the county's implementation of service 2 14 management provisions for mental health services or for mental 2 15 retardation and developmental disabilities services in 2 16 accordance with the county's approved management plans under 2 17 Code section 331.439. Code section 331.439 requires the 2 18 county, as a condition of state funding provisions, to 2 19 implement the service management provisions for mental health 2 20 and for mental retardation and developmental disabilities. 2 21 To exercise the supplemental levy authority, a county board 2 22 of supervisors must project that revenues for the county's 2 23 mental health, mental retardation, and developmental 2 24 disabilities services fund will not be sufficient to pay all 2 25 of the costs chargeable to the fund in the fiscal year. In 2 26 addition, the board must obtain the concurrence of the state- 2 27 county management committee for the board's projections and 2 28 adopt a resolution authorizing the levy. 2 29 An applicability section provides that the supplemental 2 30 levy authority first applies to taxes payable in the fiscal 2 31 year beginning July 1, 1999. 2 32 LSB 3675HH 77 2 33 jp/jw/5
