PAG LIN 1 1 Section 1. Section 147.14, subsection 4, Code 1997, is 1 2 amended to read as follows: 1 3 4. For dental examiners, five members shall be licensed to 1 4 practice dentistry, two members shall be licensed to practice 1 5 dental hygiene and two members not licensed to practice 1 6 dentistry or dental hygiene and who shall represent the 1 7 general public. A majority of the members of the board shall 1 8 constitute a quorum. No member of the dental faculty of the 1 9 school of dentistry at the state University of Iowa shall be 1 10 eligible to be appointed. Beginning January 1, 2000, persons 1 11 appointed to the board as dental hygienist members shall not 1 12 be employed by or receive any form of remuneration from a 1 13 dental or dental hygiene educational institution. The two 1 14 dental hygienist board members and one dentist board member 1 15 shall constitute a dental hygiene committee of the board as 1 16 provided in section 153.33A. 1 17 Sec. 2. NEW SECTION. 153.33A DENTAL HYGIENE COMMITTEE. 1 18 1. A three-member dental hygiene committee of the board of 1 19 dental examiners is created, consisting of the two dental 1 20 hygienist members of the board and one dentist member of the 1 21 board. The dentist member of the committee must have 1 22 supervised and worked in collaboration with a dental hygienist 1 23 for a period of at least three years immediately preceding 1 24 election to the committee. The dentist member shall be 1 25 elected to the committee annually by a majority vote of board 1 26 members. 1 27 2. The committee shall have the authority to adopt 1 28 recommendations regarding the practice, discipline, education, 1 29 examination, and licensure of dental hygienists, subject to 1 30 subsection 3, and shall carry out duties as assigned by the 1 31 board. The committee shall have no regulatory or disciplinary 1 32 authority with regard to dentists, dental assistants, dental 1 33 lab technicians, or any other auxiliary dental personnel. 1 34 3. The board shall ratify recommendations of the committee 1 35 at the first meeting of the board following adoption of the 2 1 recommendations by the committee, or at a meeting of the board 2 2 specifically called for the purpose of board review and 2 3 ratification of committee recommendations. The board shall 2 4 decline to ratify committee recommendations only if the board 2 5 makes a specific finding that a recommendation exceeds the 2 6 jurisdiction or expands the scope of the committee beyond the 2 7 authority granted in subsection 2, creates an undue financial 2 8 impact on the board, or is not supported by the record. The 2 9 board shall pay the necessary expenses of the committee and of 2 10 the board in implementing committee recommendations ratified 2 11 by the board. 2 12 4. This section shall not be construed as impacting or 2 13 changing the scope of practice of the profession of dental 2 14 hygiene or authorizing the independent practice of dental 2 15 hygiene. 2 16 EXPLANATION 2 17 This bill provides for the creation of a dental hygiene 2 18 committee within the board of dental examiners, comprised of 2 19 the two dental hygienist members of the board and one dentist 2 20 member. The dentist member must have supervised and worked in 2 21 collaboration with a dental hygienist for at least the three- 2 22 year period immediately preceding election to the committee, 2 23 and shall be elected to the committee by annual vote of the 2 24 board membership. The dental hygiene committee shall carry 2 25 out duties as assigned by the board and shall have the 2 26 authority to adopt recommendations regarding the practice, 2 27 discipline, education, examination, and licensure of dental 2 28 hygienists. The committee shall have no regulatory authority 2 29 with respect to dentists, dental assistants, dental lab 2 30 technicians, or any other dental auxiliary personnel. 2 31 Committee recommendations shall be ratified by the board at a 2 32 board meeting at which adopted committee recommendations are 2 33 reviewed, unless found by the board to exceed committee 2 34 jurisdiction or scope of authority, to create an undue 2 35 financial impact on the board, or not to be supported by the 3 1 record. The bill provides that the creation and operation of 3 2 the committee in no way expands the scope of practice of the 3 3 profession of dental hygiene, or authorizes the independent 3 4 practice of dental hygiene. Expenses of the committee and the 3 5 board in implementing ratified committee recommendations shall 3 6 be provided for by the board. 3 7 The bill also provides that dental hygienists appointed to 3 8 the board beginning January 1, 2000, shall not receive any 3 9 form of remuneration from, or be employed by, a dental or 3 10 dental hygiene educational institution. 3 11 LSB 3279HH 77 3 12 rn/sc/14.1
