1 1 Section 1. NEW SECTION. 232.120 PREADOPTIVE CARE –
1 2 CONTINUED PLACEMENT.
1 3 If a foster parent is providing preadoptive care to a child
1 4 for whom a termination of parental rights petition has been
1 5 filed, the placement of the child with that foster parent
1 6 shall continue through the termination of parental rights
1 7 proceeding unless the court orders otherwise based upon the
1 8 best interests of the child.
1 9 EXPLANATION
1 10 This bill requires the continued placement of a child with
1 11 a foster parent who is a prospective adoptive parent for the
1 12 child during a termination of parental rights proceeding
1 13 unless the court orders otherwise based upon the best
1 14 interests of the child. The bill refers to a foster parent
1 15 providing preadoptive care which is defined by the juvenile
1 16 justice code as "provision of parental nurturing on a full-
1 17 time basis to a child in foster care by a person who has
1 18 signed a preadoptive placement agreement with the department
1 19 of human services for the purposes of proceeding with a legal
1 20 adoption of the child". Parental nurturing includes but is
1 21 not limited to furnishing of food, lodging, training,
1 22 education, treatment, and other care.
