  1  1    Section 1.  Section 717B.2, unnumbered paragraph 1, Code
  1  2 1997, is amended to read as follows:
  1  3    A person is guilty of animal abuse if the person
  1  4 intentionally injures, maims, disfigures, or destroys an
  1  5 animal owned by another person, in any manner, including
  1  6 intentionally poisoning the animal.  A person guilty of animal
  1  7 abuse is guilty of an aggravated misdemeanor a class "D"
  1  8 felony.  This section shall not apply to any of the following:  
  1  9                           EXPLANATION
  1 10    This bill increases the penalty applicable to animal abuse
  1 11 from an aggravated misdemeanor to a class "D" felony.  An
  1 12 aggravated misdemeanor is punishable by imprisonment not to
  1 13 exceed two years and a fine of at least $500 but not more than
  1 14 $5,000.  A class "D" felony is punishable by imprisonment of
  1 15 not to exceed 5 years and a fine of at least $500 but not more
  1 16 than $7,500.
