1 1 Section 1. NEW SECTION. 507B.15 REQUIRED DISCLOSURE OF
1 2 PHYSICAL INFORMATION.
1 3 1. It is an unfair trade practice for a person who
1 4 requires an individual to submit to a physical examination for
1 5 purposes of an application for or renewal of a policy or
1 6 contract of insurance, to refuse to provide the results of
1 7 such physical exam to the individual.
1 8 2. For purposes of this section, "person" includes an
1 9 organized delivery system licensed by the director of public
1 10 health. The director of the Iowa department of public health
1 11 shall adopt rules implementing this section with regard to
1 12 organized delivery systems.
1 13 EXPLANATION
1 14 This bill creates a new Code section 507B.15 and provides
1 15 that an insurer or organized delivery system which requires an
1 16 individual to submit to a physical examination for purposes of
1 17 an application for, or renewal of, health care benefit
1 18 coverage, must provide the results of such physical exam to
1 19 the individual. Failure to provide such results is an unfair
1 20 trade practice and subject to the penalties provided in Code
1 21 chapter 507B.
