1 1 Section 1. Section 144A.3, subsection 4, Code 1997, is
1 2 amended to read as follows:
1 3 4. A declaration or similar document executed in another
1 4 state or jurisdiction in compliance with the law of that state
1 5 or jurisdiction shall be deemed valid and enforceable in this
1 6 state, to the extent the declaration or similar document is
1 7 consistent with the laws of this state. A declaration or
1 8 similar document executed by a veteran of the armed forces
1 9 which is in compliance with the federal department of veterans
1 10 affairs advance directive requirements shall be deemed valid
1 11 and enforceable.
1 12 Sec. 2. Section 144B.3, subsection 4, Code 1997, is
1 13 amended to read as follows:
1 14 4. A durable power of attorney for health care or similar
1 15 document executed in another state or jurisdiction in
1 16 compliance with the law of that state or jurisdiction shall be
1 17 deemed valid and enforceable in this state, to the extent the
1 18 document is consistent with the laws of this state. A durable
1 19 power of attorney or similar document executed by a veteran of
1 20 the armed forces which is in compliance with the federal
1 21 department of veterans affairs advance directive requirements
1 22 shall be deemed valid and enforceable.
1 23 EXPLANATION
1 24 This bill provides that an advance directive declaration or
1 25 similar document, executed by a veteran of the armed forces,
1 26 which complies with the federal department of veterans affairs
1 27 requirements for advance directives is deemed valid and
1 28 enforceable in Iowa under the life-sustaining procedures Act
1 29 (Code chapter 144A) and the durable power of attorney for
1 30 health care chapter of the Code (chapter 144B).
