  1  1    Section 1.  NEW SECTION.  99F.5A  MORATORIUM FOR ISSUANCE
  1  2 OF LICENSES FOR EXCURSION GAMBLING BOATS AND ON THE NUMBER AND
  1  3 TYPE OF GAMBLING GAMES.
  1  4    1.  The total number of licenses issued to conduct gambling
  1  5 games on excursion gambling boats pursuant to this chapter
  1  6 shall not exceed ten until July 1, 2003.
  1  7    2.  Notwithstanding subsection 1, the following actions may
  1  8 be taken during the moratorium from July 1, 1998, until July
  1  9 1, 2003, with the approval of the commission:
  1 10    a.  A licensed excursion gambling boat may move to a new
  1 11 location within the same county.
  1 12    b.  A licensed excursion gambling boat and its facilities
  1 13 may be sold and a new license may be issued for operation in
  1 14 the same county.
  1 15    c.  If a license to conduct gambling games on an excursion
  1 16 gambling boat is surrendered, not renewed, or revoked, a new
  1 17 license may be issued for operation in the same county.
  1 18    3.  During the moratorium from July 1, 1998, until July 1,
  1 19 2003, the commission shall not authorize any of the following:
  1 20    a.  An increase in the number or type of gambling games or
  1 21 the number of slot machines on excursion gambling boats which
  1 22 are located and operated on the Mississippi or Missouri
  1 23 rivers.
  1 24    b.  A number of slot machines at a pari-mutuel racetrack
  1 25 which is greater than the number authorized on or before July
  1 26 1, 1998.
  1 27    Sec. 2.  Section 99F.7, subsection 1, Code 1997, is amended
  1 28 to read as follows:
  1 29    1.  If the commission is satisfied that this chapter and
  1 30 its rules adopted under this chapter applicable to licensees
  1 31 have been or will be complied with, the commission shall issue
  1 32 a license for a period of not more than three years to an
  1 33 applicant to own a gambling game operation and to an applicant
  1 34 to operate an excursion gambling boat.  The commission shall
  1 35 decide which of the gambling games authorized under this
  2  1 chapter it will permit.  The commission shall decide the
  2  2 number, location, and type of excursion gambling boats
  2  3 licensed under this chapter for operation on the rivers,
  2  4 lakes, and reservoirs of this state.  However, after July 1,
  2  5 2003, the commission shall issue a new license for an
  2  6 excursion gambling boat operation only if the excursion
  2  7 gambling boat operates on the Mississippi or Missouri river.
  2  8 The license shall set forth the name of the licensee, the type
  2  9 of license granted, the place where the excursion gambling
  2 10 boats will operate and dock, and the time and number of days
  2 11 during the excursion season and the off season when gambling
  2 12 may be conducted by the licensee.  The commission shall not
  2 13 allow a licensee to conduct gambling games on an excursion
  2 14 gambling boat while docked during the off season if the
  2 15 licensee does not operate gambling excursions for a minimum
  2 16 number of days during the excursion season.  The commission
  2 17 may delay the commencement of the excursion season at the
  2 18 request of a licensee.  
  2 19                           EXPLANATION
  2 20    The bill imposes a moratorium on the issuing of licenses to
  2 21 conduct gambling games on excursion gambling boats until July
  2 22 1, 2003, and freezes the number of excursion gambling boat
  2 23 licenses at 10.  The moratorium includes the number and types
  2 24 of gambling games and the number of slot machines which can be
  2 25 operated on an excursion gambling boat and the number of slot
  2 26 machines which can be operated at a pari-mutuel racetrack.
  2 27 The moratorium on the number and types of gambling games
  2 28 including the number of slot machines operated on excursion
  2 29 gambling boats applies only to the excursion gambling boats
  2 30 operated on the Mississippi or Missouri river.
  2 31    During the moratorium, an excursion gambling boat may be
  2 32 sold and a new license may be issued in the same county.  The
  2 33 operation of an excursion gambling boat may be relocated
  2 34 within a county with the commission's approval and the
  2 35 commission may reissue for the same county a license that is
  3  1 surrendered, not renewed, or revoked.
  3  2    After July 1, 2003, the commission shall issue new licenses
  3  3 for excursion gambling boat operations only if the excursion
  3  4 gambling boat operates on the Mississippi or Missouri river.
