PAG LIN 1 1 Section 1. Section 230.1, Code 1997, is amended to read as 1 2 follows: 1 3 230.1 LIABILITY OF COUNTY AND STATE. 1 4 1. The necessary and legal costs and expenses attending 1 5 the taking into custody, care, investigation, admission, 1 6 commitment, and support of a person with mental illness 1 7 admitted or committed to a state hospital shall be paid as 1 8 follows: 1 91a. By the county in which such person has a legal 1 10 settlement, or. 1 112b. By the state when such person has no legal settlement 1 12 in this state, or when such settlement is unknown. 1 13 c. Notwithstanding section 252.16, by the state when such 1 14 person is a juvenile. For purposes of this paragraph, 1 15 "juvenile" means a person under eighteen years of age. 1 16 2. The legal settlement of any person found mentally ill 1 17 who is a patient of any state institution shall be that 1 18 existing at the time of admission thereto. 1 19 3. A county of legal settlement is not liable for costs 1 20 and expenses associated with a person with mental illness 1 21 unless the costs and expenses are for services and other 1 22 support authorized for the person through the single entry 1 23 point process. For the purposes of this chapter, "single 1 24 entry point process" means the same as defined in section 1 25 331.440. 1 26 EXPLANATION 1 27 This bill provides that the expenses and costs of a person 1 28 with mental illness admitted or committed to a state hospital 1 29 are to be paid by the state if the person is a juvenile.
