  1  1    Section 1.  Section 222.73, subsection 2, Code 1997, is
  1  2 amended by adding the following new paragraph:
  1  3    NEW PARAGRAPH.  g.  If the billing for the cost of a
  1  4 patient's care was certified to the director of revenue and
  1  5 finance more than one hundred twenty days after the earliest
  1  6 date the patient received care during the preceding calendar
  1  7 quarter, the county shall not be responsible for the cost of
  1  8 care provided to the patient.  Instead, the amount which would
  1  9 have otherwise been chargeable to the county shall be paid by
  1 10 the state from moneys appropriated in section 222.69 and the
  1 11 requirement for itemized vouchers executed by the auditor
  1 12 shall not apply.
  1 13    Sec. 2.  Section 230.20, subsection 2, Code 1997, is
  1 14 amended by adding the following new paragraph:
  1 15    NEW PARAGRAPH.  c.  If the billing for the cost of services
  1 16 provided to a patient was certified to the director of revenue
  1 17 and finance more than one hundred twenty days after the
  1 18 earliest date the services were chargeable to the county in
  1 19 the previous calendar quarter, the county shall not be
  1 20 responsible for the cost of care provided to the patient.
  1 21 Instead, the amount which would have otherwise been chargeable
  1 22 to the county shall be paid by the state from moneys
  1 23 appropriated in section 230.11 and the requirement for
  1 24 itemized vouchers executed by the auditor shall not apply.
  1 25    Sec. 3.  Section 233B.14, Code 1997, is amended to read as
  1 26 follows:
  1 27    233B.14  COUNTIES LIABLE.
  1 28    1.  Each A county is liable for sums paid by the home in
  1 29 support of all its children chargeable to the county to the
  1 30 extent of a sum equal to one-half of the net cost of the
  1 31 support and maintenance of its those children.  The
  1 32 superintendent shall certify to the director of revenue and
  1 33 finance on the first day of each fiscal quarter the amount
  1 34 chargeable to each county for support in the previous fiscal
  1 35 quarter.  If an amount was certified to the director of
  2  1 revenue and finance more than one hundred twenty days after
  2  2 the earliest date the amount was chargeable to the county in
  2  3 the previous fiscal quarter, the county shall not be
  2  4 responsible for the amount charged.  Instead, the amount which
  2  5 would have otherwise been chargeable to the county shall be
  2  6 the responsibility of the state.
  2  7    2.  The sums for which each a county is liable shall be
  2  8 charged to the county and collected as a part of the taxes due
  2  9 the state, and shall be paid by the county at the same time
  2 10 state taxes are paid.
  2 11    3.  Should any If a county fail fails to pay these bills
  2 12 the amount chargeable to the county within sixty days from the
  2 13 date of certificate from certification by the superintendent,
  2 14 the director of revenue and finance shall charge the
  2 15 delinquent county the penalty of one percent per month on and
  2 16 after sixty days from the date of certificate certification
  2 17 until paid.  Such Delinquent payment penalties shall be
  2 18 credited to the general fund of the state.  
  2 19                           EXPLANATION
  2 20    This bill relates to billings to counties for services
  2 21 provided by the following institutions administered by the
  2 22 department of human services:  state hospital-schools, state
  2 23 mental health institutes, and the Iowa juvenile home.  The
  2 24 bill provides that if the date of the department's
  2 25 certification of an amount chargeable to a county is more than
  2 26 120 days following the first date of service in the previous
  2 27 quarter, the county is not responsible for the chargeable
  2 28 amount.
  2 29    For the state hospital-schools and state mental health
  2 30 institutes, the bill provides the amount otherwise chargeable
  2 31 to the county is to be paid by standing appropriations for
  2 32 cases payable by the state.  For the Iowa juvenile home, the
  2 33 bill provides the amount otherwise chargeable to the county is
  2 34 a state responsibility.  Code section 233B.14 is also amended
  2 35 to divide and number paragraphs as subsections.
