1 1 Section 1. Section 249A.26, Code 1997, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 4. If the nonfederal share of a service
1 4 is funded in whole or in part by a county and the county
1 5 determines the billing for the service or the cost reports
1 6 used to develop the reimbursement rate for the service are
1 7 inaccurate or do not accurately reflect the costs which are
1 8 chargeable to medical assistance, the county may request the
1 9 department to revise the reimbursement rate to adjust for the
1 10 inaccuracy. The billing and cost reports relating to a
1 11 service may be considered for inaccuracy and rate adjustment
1 12 for the ten years prior to the date of the request. If the
1 13 department determines there is an inaccuracy in the billing or
1 14 the cost reports are inaccurate or do not accurately reflect
1 15 the costs which are chargeable to medical assistance, the
1 16 department shall adjust the reimbursement rate for the service
1 17 to correct the inaccuracy.
1 18 EXPLANATION
1 19 This bill relates to medical assistance services for which
1 20 all or part of the nonfederal share is paid by counties. The
1 21 bill amends Code section 249A.26, relating to state and county
1 22 participation in funding for services under the medical
1 23 assistance program. The amendment allows a county which has
1 24 determined that a billing or the cost reports used to
1 25 determine the service reimbursement rate are inaccurate or do
1 26 not accurately reflect the costs which are chargeable to
1 27 medical assistance, to request the department of human
1 28 services to revise the reimbursement rate to correct the
1 29 inaccuracy. If the department determines the inaccuracy
1 30 exists, the department shall adjust the reimbursement rate to
1 31 correct the inaccuracy.
