1 23 secretary of state and inserting in lieu thereof the words
1 24 "director" and "director's", as appropriate.
1 25 2. The Code editor is directed to substitute the words
1 26 "director of revenue and finance" for the words "secretary of
1 27 state" and the words "director" or "director's" for the words
1 28 "secretary" or "secretary's", as appropriate, in chapters 9A,
1 29 9C, 9D, 9G, 9H, 461B, 491, 534, 567, and 591, Code 1997, and
1 30 in chapters 9E, 261B, 487, 490, 490A, 497, 498, 499, 504A,
1 31 515, 524, 548, and 554, Code Supplement 1997, when the words
1 32 are used to refer to the secretary of state.
1 33 3. The Code editor is directed to substitute the words
1 34 "director of revenue and finance" for the words "secretary of
1 35 state" and the words "director" or "director's" for the words
2 1 "secretary" or "secretary's", as appropriate, in provisions of
2 2 the Code not otherwise specified in subsections 1 and 2, when
2 3 the words are used to refer to the secretary of state and
2 4 there appears to be no doubt that the references are to duties
2 5 which are transferred to the director of revenue and finance
2 6 pursuant to subsections 1 and 2.

2 9 1. Sections 1A.1, 9.1, 9.3, 9.4, 9.6, 34A.6, 312.3, and
2 10 405A.3, Code 1997, are amended by striking from the sections
2 11 the words "secretary of state" and inserting in lieu thereof
2 12 the words "director of the department of general services",
2 13 and by striking from the sections the words "secretary" and
2 14 "secretary's" when the words are used to refer to the
2 15 secretary of state and inserting in lieu thereof the words
2 16 "director" and "director's", as appropriate.
2 17 2. The Code editor is directed to substitute the words
2 18 "director of the department of general services" for the words
2 19 "secretary of state" and the words "director" or "director's"
2 20 for the words "secretary" or "secretary's", as appropriate, in
2 21 chapter 9F, Code 1997, when the words are used to refer to the
2 22 secretary of state.
2 23 3. The Code editor is directed to substitute the words
2 24 "director of the department of general services" for the words
2 25 "secretary of state" and the words "director" or "director's"

2 33 Sec. 3. TRANSFER OF DUTIES FROM SECRETARY OF STATE TO THE
2 34 ETHICS AND CAMPAIGN DISCLOSURE BOARD DIRECTIVES TO CODE
2 35 EDITOR.
3 1 1. Sections 42.4, 43.18, 43.67, 44.3, 45.3, 47.1, 48A.19,
3 2 49A.8, 50.41, 50.43, 56.5, 59.4, 59.7, 60.2, 60.3, 60.4, 60.6,
3 3 61.2, 61.11, 68B.35A, 69.4, 161A.10, and 331.510, Code 1997,
3 4 and sections 48A.22 and 59.1, Code Supplement 1997, are
3 5 amended by striking from the sections the words "secretary of
3 6 state" and inserting in lieu thereof the words "ethics and
3 7 campaign disclosure board", and by striking from the sections
3 8 the words "secretary" and "secretary's" when the words are
3 9 used to refer to the secretary of state and inserting in lieu
3 10 thereof the words "board" and "board's", as appropriate.
3 11 2. The Code editor is directed to substitute the words
3 12 "ethics and campaign disclosure board" for the words
3 13 "secretary of state" and the words "executive director" or
3 14 "executive director's" for the words "secretary" or
3 15 "secretary's", as appropriate, in provisions of the Code not
3 16 otherwise specified in subsection 1, when the words are used
3 17 to refer to the secretary of state and there appears to be no
3 18 doubt that the references are to duties which are transferred
3 19 to the executive director of the ethics and campaign
3 20 disclosure board pursuant to subsection 1.
3 21 Sec. 4. EFFECTIVE DATES IMPLEMENTATION TRANSFER OF
3 22 RECORDS.
3 23 1. This Act takes effect January 1 following the general
3 24 election at which the electorate ratifies an amendment to the
3 25 Constitution of the State of Iowa to eliminate the office of
3 26 secretary of state.
3 27 2. In order to implement sections 1, 2, and 3 of this Act,
3 28 upon ratification of an amendment to the Constitution of the
3 29 State of Iowa to eliminate the office of the secretary of
3 30 state, the secretary of state, in consultation with the
3 31 director of revenue and finance, the director of the
3 32 department of general services, and the executive director of
3 33 the ethics and campaign disclosure board, shall coordinate the
3 34 transfer to each of the aforementioned as appropriate, of any
3 35 books, accounts, records, forms, filings, or similar documents
4 1 maintained by the secretary of state in the performance of the
4 2 secretary's duties prior to the transfer of those duties in
4 3 accordance with this Act.
4 4 EXPLANATION
4 5 This bill reassigns the duties currently assigned to the
4 6 secretary of state and transfers them to the director of
4 7 revenue and finance, the director of the department of general
4 8 services, and the executive director of the ethics and
4 9 campaign disclosure board upon ratification of an amendment to
4 10 the Constitution of the State of Iowa eliminating the office
4 11 of secretary of state.
4 12 In general, the director of revenue and finance is assigned
4 13 those duties relating to corporate filing requirements,
4 14 including filing requirements for corporate or partnership
4 15 farming operations, and various registration requirements,
4 16 such as the registration of athletic agents, waste tire
4 17 haulers, transient merchants, travel agents, and trademarks.
4 18 Collective bargaining agreements currently required to be
4 19 filed with the secretary of state are required by the bill to
4 20 be filed with the director of revenue and finance. The bill
4 21 also transfers those duties of the secretary of state relating
4 22 to the state fair board to the director of revenue and
4 23 finance. Filing requirements relating to grain dealers,
4 24 agricultural warehousers, pesticide dealers, and agricultural
4 25 supply dealers are transferred to the director of revenue and
4 26 finance. Acceptance of service of process for entities
4 27 located outside the state is currently with the office of
4 28 secretary of state. With a few exceptions, acceptance of
4 29 service of process for out-of-state entities is transferred to
4 30 the director of revenue and finance. Those duties of the
4 31 secretary of state relating to the sale of school lands, the
4 32 registration of postsecondary schools, and interstate
4 33 educational personnel agreements are transferred to the
4 34 director of revenue and finance. Those duties pertaining to
4 35 acceptance of filing of a city annexation, severance, boundary
5 1 adjustment, or name change are transferred to the director of
5 2 revenue and finance. Finally, the bill provides that those
5 3 charter government documents required to be filed with the
5 4 secretary of state shall be filed with the director of revenue
5 5 and finance.
5 6 All duties relating to elections, local referenda, voter
5 7 registration, and campaign finance are transferred to the
5 8 ethics and campaign disclosure board.
5 9 Duties relating to the gathering, compilation, and
5 10 publication of census statistics are transferred to the
5 11 department of general services. The duties relating to
5 12 publication of the Acts and resolutions of the state and
5 13 general assembly, to publication of the Iowa official
5 14 register, and to filing of commissions issued by the governor
5 15 are also transferred to the director of the department of
5 16 general services. Duties relating to the adoption of rules
5 17 for the conduct of joint E911 service referendums are
5 18 transferred to the director of the department of general
5 19 services.
5 20 The bill provides for the secretary of state to coordinate
5 21 with the director of revenue and finance, the director of the
5 22 department of general services, and the ethics and campaign
5 23 disclosure board concerning the transfer of records pertaining
5 24 to duties that are transferred under the bill.
5 25 The bill takes effect January 1 following ratification by
5 26 the people of an amendment to the Constitution of the State of
5 27 Iowa eliminating the office of secretary of state.
